authority is to affirm to reverse or to modify. If the Commission requires three to vote, there could <br />be an extension at a later date when all three could attend. A suggestion was made to keep two (2) <br />as a quorum. Mr. Herbster had inquired about the quorum. "I had a question about two (2) <br />members present short disciplinary. This body is supposed to be a neutral body, correct and by if <br />you have a one (1) to one (1) split, one says if they think the City is right and one thinks the <br />applicant or the grievant is right, to me that would mean that there is some merit there to the case <br />and you've weighted the panelizes towards the employee and given the employer benefit whole leg <br />up by having two people present and not having the opportunity to have that third person cast a vote <br />either yea or neigh so I am wondering if by adopting that ruling you are not neutral anymore but <br />you've actually given the employer the benefit that is not afforded to the employee". The <br />Commission will take this under advisement. <br />Rule I Section 1 a: "Reasonable notice of competitive entrance examinations shall be given through <br />the local newspapers. A notice of upcoming competitive entrance examinations shall also be posted <br />in conspicuous places, as determined by the Commission for a period of at least two (2) weeks <br />before the examination date". A suggestion was made to keep the spirit of the change but revise <br />the language: "a notice of upcoming competitive entrance examinations shall be posted in <br />conspicuous places as determined by the Commission on a date no less than two (2) weeks before <br />the date of the examination". A general discussion followed concerning the beginning of the <br />sentence with "Reasonable"; examination timeline; a sound rule for other Commissioners to follow. <br />The Commission decided to reject the changes at this time. <br />Rule I Section lb: "Should an eligibility list expire subsequent to the start of the interview process, <br />the Appointing Authority may continue to hire from the expired eligibility list for thatparticular <br />position ". A suggestion was made for this section to be removed and add it to Rule VIII, Section <br />Id. This section instructs or guides the interaction between the Civil Service Commission and the <br />appointing authority. <br />Rule II, Section la: "Applicants shall be citizens of the United States and those persons who have <br />legally declared their intentions of becoming United States citizens' . A general discussion <br />followed concerning amendments to state law; revised language; residency requirement. The Law <br />Department will look into this matter. <br />Rules II, Section lc: "Applicants shall possess all other prerequisite qualifications established by <br />the Commission, which may include educational requirements as a condition of taking such <br />examination, as determined by Rule of the Commission with regard to prerequisites expressly <br />imposed by law or which the appointing authority may propose and the Commission may <br />determine to be specifically job-related': A recommendation was made to accept the language <br />verbatim. <br />A general discussion commenced concerning Rule II, Section 3 through 5. An inquiry was made if <br />it is the Commission's concern what vision standards Police and Fire use. In some degree the <br />Commission is setting the rules and providing the forum for the appointing authority on the <br />qualification of a candidate. If the standards are not spelled out, the appointing authority does not <br />have any guidelines to follow. <br />Rule II, Section 8a: "Entry-level candidates for the Police Department shall be required to pass an <br />agility test. The test will be the "Police Agility Exam " administered by Cuyahoga Community <br />College. Candidates shall be responsible for registration in the program and meeting all <br />prerequisites and fees as stipulated by the test administrator. Candidates shall submit valid <br />
