a <br />Section 4: accept all the changes; change the first part of text to "a" and then the current "a" will be <br />"b" so on and so forth so that Section 4 will have subsections a through d; add the word Sections <br />after "Ohio Revised Code" and complete a global search on the whole document. <br />Section 5: hyphenate the word laid off, replace the suggested word immediate to immediately; the <br />first block of text will be Section 5 a and Section 5 b will begin with "A laid -off employee..."; <br />indent 1 through 3. <br />Section 6: the first part of the text will be Section 6 a and the current a and b will become b and c. <br />Mr. Ubaldi made a motion to apply all changes that have been made to Rules IX, X and XI <br />and the new set of Rules and Regulations be distributed. Mr. Hohmann seconded the motion <br />and unanimously approved. <br />A general discussion commenced regarding the update of the appendix; definitions and preface will <br />need to be scrutinized; review any outstanding issues. <br />A discussion followed concerning Rule XII, page 25, d where drunkenness is there as a possible <br />reason for suspension or to be removed from the position and an inquiry was made if the <br />Commission would consider the use of illegal drugs as another reason. The Commission had <br />,previous discussions concerning inappropriate use of alcohol and the use of illegal drugs and that <br />the use of the word drunkenness has been used historically in the statues. An inquiry was made if <br />the administration is aware of any potential problems with any of the disabilities act where people <br />have alcoholism or drug addictions that could have some impact on that change. The City has a <br />drug and alcohol policy; it is the Bureau of Workers Comp Drug Free Workplace Level 1 and as <br />part of that program the Employer is required to have in place an Employee Assistance Program; if <br />the City would have an employee that would have a problem, the City can and would refer them to <br />the EAP for counseling and then a recommendation back to the Employer on how best to handle the <br />situation. Illegal drugs are controlled substances and the possession and use is absolutely <br />prohibited; that would constitute abuse. The "use of abusive controlled substances" will now. be <br />Section 1 e and the rest will change accordingly. <br />Mr. Ubaldi made a motion to apply the changes discussed to Rule XII and any other changes <br />to the rules discussed at this meeting. Ms. Zolar seconded the motion and unanimously <br />approved. <br />A general discussion commenced regarding the Definition Section; there could be a variance <br />between some of the terms as they were defined then; the lack of funds, lack of work has been <br />changed; reviewing individual definitions; redundancy. The Rules and Regulations handbook is <br />fairly easy reading. The most difficult aspects of the rule book are the logical constructs, the <br />interworking of the rules and the confusion that the Commission has seen that can arise sometimes <br />not only with those that are affected by the rules but the City staff and the Commission itself. A <br />suggestion was made that the Law Department review the Definition Section of the rules and <br />present their opinion at the next meeting. <br />The Preface will be discussed at the next meeting and as far as the loose ends based on the previous <br />discussions about vision, the Commission will keep the current language. <br />Rule III, Police and Fire Promotion, has been set aside for input from the respective Chiefs. The <br />Law Department indicated that the change in State Law was a function of the Fire O.R.C. Section <br />124.45, increasing the time in rank to forty-eight (48) months; for consistency, the time and rank <br />proposal for police was offered also to the Commission at forty-eight (48) months.
