v� <br />VI. <br />Service Director, and is a non -bargaining position; compensated salary is in the mid $50's; the <br />current employee will complete his 35th year in July, 2008. This employee has knowledge of <br />construction, reading blue prints, experience with concrete and asphalt, supervisor to bargaining <br />unit employees; knowledge and maintenance of equipment, how to shoot grades, etc. The City <br />advertises in the Plain Dealer for mainly non -bargaining positions. The Animal Warden is another <br />position that was not practicable to test for and was considered classified more easily and <br />appropriately filled by hiring from the direct action by the Administration. The Commission should <br />review in detail before deciding if the Road Foreman is a testable position and if it is considered <br />promotional or entry-level. Some employees may want to test for this position and some may want <br />to remain in the union. The appointing authority does not intend to make a temporary appointment <br />and does not feel that this is a testable position. The Civil Service -Commission, after legal counsel, <br />makes the determination if this position is filled by a direct appointment or a competitive test. <br />Employees have been on the books so long that no one has any recollection on how positions were <br />filled in the past. It is probably also a function of the fact the Service Collective Bargaining <br />Agreement provides for filling vacancies and as a result for Service the promotions are done <br />through the labor contract instead of through the Civil Service testing as in Police and Fire and as <br />with done at the Waste Water Treatment Plant. Mr. Ubaldi indicated that that would be one aspect <br />contributing to the determination. The appointing authority should be presenting to the <br />Commission the vacancy and intent to proceed or asking not to hold a competitive examination. An <br />example was the Building Commissioner pleading his case that one Building Inspector needs to <br />have a plumbing certification and that under the Board of Building Standards the City has to have a <br />certified plumbing inspector. A general discussion followed regarding testable/non-testable <br />positions; designing and administering the test in house; out sourcing to testing agencies. The <br />Commission's concerns would be if this is a testable or non: testable position; if the examination is <br />entry-level or -promotional; if a reasonable amount of applicants will show up.
