CITY OF NORTH OLMSTED <br />CIVIL SERVICE COMMISSION MEETING �\ <br />CITY COUNCIL CAUCUS ROOM <br />MINUTES - SEPTEMBER 15, 2008 <br />7:00 P.M. <br />I. ROLL CALL: Chairman M. Ubaldi called the meeting to order at 7:02 p.m. <br />PRESENT: M. Ubaldi and B. Hohmann <br />ALSO PRESENT: Human Resources Director C. Farver, Service Director D. Limpert, Assistant <br />Law Director B. O'Malley, Civil Service Secretary D. Eccleston <br />II. DISPOSITION OF MINUTES: <br />The Civil Service minutes dated August 18, 2008 have been submitted for approval. <br />Mr. Ubaldi made a motion to accept the minutes as submitted. Mr. Hohmann seconded the <br />motion and unanimously approved. <br />III. COMMUNICATIONS: <br />There were 7 items of correspondence received and 4 items of correspondence sent out by the <br />Civil Service Commission. <br />IV. OLD BUSINESS: <br />Review Rule III, Police and Fire Promotions, Section 3, Police Promotions <br />An amended draft of Rule III, Police and Firefighter Promotions, Section 3, Police Promotions was <br />provided to the Commission from the Chairman. Chief Wozniak's concern and desire was <br />Patrolmen be required to serve thirty-six (36) months, including the twelve (12) months <br />probationary period, for a scheduled promotional examination. A general discussion followed. <br />The Chairman provided a draft of Rule IX, Temporary and Exceptional Appointments. Language <br />concerning temporary appointment was something a little more complicated in the handbook prior <br />to the Commission's comprehensive changes. The language was removed entirely and the <br />Chairman wanted to reinsert some language that he had drafted. The draft governs the situation in <br />which a temporary employee would be filling a position for which an eligible list would be filled by <br />a competitive examination. The rule has limited the window of an appointment of one hundred <br />twenty (120) days after which you cannot fill that position through a temporary appointment; a great <br />deal of language was removed, but here it simply requires the employee to compete with all others. <br />The basic concept is that the temporary appointee acquires no standing and does not become a <br />classified civil servant by default. On the front end there is no promise or expectation of continued <br />employment and this rule pertains to the back end which provides termination of a temporary <br />employee that is not qualified through testing and selection by the appointing authority. The <br />process involves the appointing authority notifying the Commission that there is no eligible list and <br />there is an urgent need to fill the position with a temporary appointment triggering a testing process <br />that would include the temporary appointee amongst the others to be tested; if they are one of the <br />
