promotional appointment. A suggestion was made regarding Section 1 b sub section i to replace <br />"except as otherwise provided within the Ohio Revised Code Sections 124,44 and 124.45" with <br />"pursuant to the Charter Article 6, Section 4." The reason for the amended change is because then <br />the rules become subservient to the State Statute, The Commission can deviate from State Law. <br />Mr, Ubaldi made a motion to amend the Rules and Regulations Handbook as provided <br />including the change by legal counsel. Ms. Zolar seconded the motion and unanimously <br />approved, <br />Promotional Police Lieutenant Examination <br />Ordinance 2007-68 was passed February 5, 2008 and created Chapter 112, Personal Services <br />Contracts. The Personal Services Contracts is a professional service. The scope of the Chapter <br />includes any expenditure of funds. If the amount is less than $25,000 then the procedure in the <br />City's ordinance dictate how that is to be conducted. In Section 112.05a, there is great deal of <br />leeway to select a firm, negotiate a proposal and it may not be through a great deal of advertising <br />and is not as formal. This procedure must be competitive and objective in turns of the selection so <br />that parties that are interested in providing the personal services have a level playing field and an <br />opportunity to pursue that contract, The Commission simply cannot turn to Ramsey & Associates <br />to test even though this testing firm has been retained since 2006 and have conducted at least a half <br />a dozen of promotional and entry-level examinations for the City of North Olmsted. The <br />Commission will have to send out for Request for Qualifications. The request for fee schedule for <br />services rendered will be included in the proposal and the introduction states for a period of two (2) <br />years which is reasonable and the terms and conditions of the contract are within the scope of the <br />Commission's endeavor. The Commission can then review submissions of Statements of <br />Qualifications that are received from firms and make a decision at next month's meeting. <br />Unfortunately that will put the process a month behind. <br />The amount budgeted .for Pre -Employment Testing was revised to $11,400 which would be for the <br />Promotional Police Lieutenant as well as the potential Promotional Police Sergeant examinations. <br />The Human Resources Director indicated today the Administration was notified that Police <br />Sergeant Simon Cesareo will be retiring on April 10`x' of this year; therefore, there will be a need for <br />a Police Sergeant's test. There will be two positions vacant; one from the candidate that will be <br />promoted to Police Lieutenant and the retirement. If the City ultimately comes to an agreement that <br />binds it for a period of two years, the amount that was put into the 2010 budget should be reviewed <br />again and the Commission may want an increase. The budget has not been approved; budget <br />hearings will be held in March so a modest increase can be submitted to the Finance Director. <br />The timeline for the Promotional testing was tentatively set to have the notice of the test sent on <br />Wednesday, February 24'x', letters of intent for the candidates that wish to compete due by the first <br />Friday of March. The test would have been held Saturday, March 27"' and the Oral Assessment on <br />March 31". A special meeting would have taken place and the Commission could have had an <br />appointment by the first or second week of April. The Police Lieutenant and Sergeant's test can be <br />run simultaneously and the Commission can immediately fill the vacant positions. <br />A general discussion commenced regarding if positions are required to be filled by a certain amount <br />time. State Code 124.44, which applies to Police, has a 60 day requirement; however, according to <br />our Charter, Civil Service Commission can deviate from State Law and has endeavored to do so. <br />Specifically because of the 60 day requirement, the Commission worked very diligently in the past <br />to meet this deadline and found it to be difficult. The Commission moved to amend its rules to <br />allow for this cycle to take more than 60 days. An example was given pertaining to the <br />
