VI. <br />Plant which is subject to it, The complication to that is whether or not the position can simply be <br />advertised as it is with no requirement of license depending upon the needs of the Treatment Plant <br />or depending on the interchangeability of these positions whether one may take a test for any <br />number of these. A discussion followed concerning the Collective Bargaining Agreement; <br />promotions; and job bidding. The most recent signed labor contract by AFSCME exempts <br />promotion from Civil Service, Under Section 4117.10a of the Ohio Revised Code, the parties' <br />collective bargaining agreement can override the Civil Service systems, The determination of <br />classified versus unclassified, classified competitive and classified non-competitive is a function of <br />the Commission by virtue of the Charter. The Civil Service Commission has the authority to <br />determine as an entry-level matter how these classified positions are filled. The AFSCME <br />Collective Bargaining Agreement, Article IXX, Title, Promotions, Bidding Transfer and Job <br />Training, states in Section 19.01 "No Civil Service exam shall be given for promotions to job <br />classifications covered by this agreement." Entry -Level positions are not covered by the labor <br />contract because they are not employees of the City at that time. The labor contract obligates the <br />Administration to post internally when there is a vacancy and the current employees are given a <br />chance to bid on it. After the bidding process is concluded and there are no internal applicants, the <br />administration will go outside. A general discussion followed regarding filling a vacancy; <br />promotion; lateral transfers; organizational charts; and family of jobs. The Administration amended <br />some of the language in Section 19 of the Collective Bargaining Agreement that allows the <br />Employer to look at the experience, skill and ability and not just the family of jobs. If the pay grade <br />is the same for the different job classes that would be a lateral transfer whereas if the pay grade was <br />higher it would be a promotion. <br />The Commission should make the designation of classifications consistent where ever possible and <br />exercise its authority; therefore, a suggestion was made that the positions of Equipment Operator, <br />Operator, Sludge Handler and Maintenance Technician should be classified. The Commission <br />received some information from the Service Director regarding positions that were included in the <br />reorganization of the Treatment Plant and documents supplied by the former Service Director, <br />Duane Limpert. A suggestion was made to invite the Service Director and if necessary, the Union <br />next month. <br />In order to come up with an up to date list of positions, the Commission would have to use the <br />organizational charts that City Council approved. If the Commission wants job descriptions the <br />Human Resources Director can provide them. The Chairman has consolidated all of these positions <br />and placed them in an order that is equivalent to the organizational chart that he was provided by <br />Duane Limpert and Sharon Schlemmer in 2009. A discussion then followed concerning Operator <br />Laborer's classification and the tentative classification list. <br />The Chairman concluded that he would like to revisit this issue in December. The Human <br />Resources Director indicated the Administration has Labor Management meetings with AFSCME <br />quarterly and this would be the type of matter that management would bring to them and would let <br />the staff representative know if that is what the Commission wants.
