V. NEW BUSINESS: <br /> Notice of Hearing on Removal of Candidate on Entry-Level Patrol Officer Eligible List <br /> Chairman Barrett indicated Eric Joyce, a candidate on the Entry-Level Patrol Officer Eligible List <br /> has been passed over three (3) times by the appointing authority. Mr. Joyce is not present; <br /> therefore, his name will be removed from the eligible list pursuant to Rule VII, Section 9h. <br /> Chairman Barrett moved, seconded by Commissioner Hayes, to remove Eric Joyce from the <br /> Entry-Level Patrol Officer Eligible List. <br /> Motioned passed unanimously. <br /> Voluntary Removal of Candidate on Entry-Level Patrol Officer Eligible Lift <br /> The Commission received a voluntary removal letter from Kevin Rybka, a candidate on the Entry- <br /> Level Patrol Officer Eligible List. Mr. Rybka's name will be removed pursuant to Rule VII, <br /> Section 10. <br /> Chairman Barrett moved, seconded by Commissioner Hayes, to remove Kevin Rypka's name <br /> from the Entry-Level Patrol Officer Eligible List. <br /> Motion passed unanimously. <br /> Entry-Level Patrol Officer Eligible List <br /> Chairman Barrett advised that the Commission will add another name to the Entry-Level Patrol <br /> Officer Eligible List. <br /> Chairman Barrett moved, seconded by Commissioner Hayes, to add the name of Nicholas <br /> May to the Entry-Level Patrol Officer Eligible List and certify the eligible list. <br /> Motion passed unanimously. <br /> Notice of Hearing Regarding Eligibility far the Promotional Fire Lieutenant's Examination <br /> The Commission has been notified concerning two (2) Firefighters who have signed up for the <br /> Promotional Fire Lieutenant Examination and is questioning their time in service. According to <br /> Rule III, Section 2a, a candidate must serve 48 months not including their probationary period. The <br /> two (2) Firefighters, Shaun Kasza and Giles Selig were laid off at the end of 2008. <br /> Firefighter Selig stated he contacted the Civil Service Office and the Secretary indicated to him that <br /> his reinstatement letter indicated that their seniority date was based off of their original date of hire. <br /> A few comments followed regarding the two (2) Firefighters having their time in grade, double <br /> penalty for being laid off and keeping up their skills while they were laid off, <br /> Rule III, Section 2, of the Civil Service Rules and Regulations states "...no person shall be eligible <br /> to take the examination unless the person has served forty eight (48) months, not including the <br /> person's probationary period, in the rank of regular firefighter."The Collective Bargaining <br /> Agreements recognizes the time in service notwithstanding the layoff, the probationary period for a <br /> firefighter is eighteen (18) months and the City still considers the laid-off firefighters hire date be <br /> the affected date. <br />
