Mayor Kennedy inquired if there is any legal opposition if the two (2) candidates take the test. <br /> Legal Counsel O'Malley advised that there can be legal consequences either way. This is a very <br /> difficult call for the Commission to decide, <br /> Chairman Barrett moved, seconded by Commissioner Hayes, to accept the eligibility of Shaun <br /> Kasza and Giles Selig under Rule III of the Civil Service Rules and Regulations. <br /> Roll Call: Chairman Barrett—no; Commissioner Hayes—yes, <br /> Chairman Barrett moved, seconded by Commissioner Hayes, to reconsider the previous <br /> motion regarding the eligibility of Shaun Kasza and Giles Selig under Rule III of the Civil <br /> Service Rules and Regulations. <br /> Motion passed unanimously. <br /> Chairman Barrett moved, seconded by Commissioner Hayes, to accept the eligibility of Shaun <br /> Kasza and Giles Selig under Rule III of the Civil Service Rules and Regulations. <br /> Motion passed unanimously. <br /> Firefighter Brian Shlapack requested from the Commission in the future to take into consideration <br /> the way the seniority extra credit points are awarded. <br /> Notice of Hearing on Request for Removal of a Candidate on Police Sergeant Eligible List <br /> Mayor Kevin Kennedy read into the record "Before you is a request from Mr. Scott Thomas, <br /> Director of Public Safety and the appointing authority for the Division of Police to remove the name <br /> of Brian Bielozer from the list of individuals' eligible for the position of Sergeant within the Police <br /> Division. Since that communication was received by you, Mr, Thomas has left the City of North <br /> Olmsted and the Director of Law, Michael Gareau has recused himself from representing the <br /> Administration in this particular matter because his office is representing the Civil Service <br /> Commission. He is obligated to do so under the Charter and he has determined that this is a <br /> conflict. City Council has authorized a request for proposal to hire independent counsel and that is <br /> under way as we speak and is not finished and will not be until later on this week. In order that the <br /> Administration proceed with the benefit of Council, I respect that the request that matter of Brian <br /> Bielozer removal from the Promotional Police Sergeant Eligile List be rescheduled for hearing at <br /> another time." <br /> An inquiry was made to Brian Bielozer or his legal counsel if have any objection for the <br /> continuance. Legal Counsel Milligan requested to discuss this matter in private. The meeting went <br /> into a short recess. <br /> Legal Counsel Patrick Milligan advised the Commission that they have an objection to the <br /> continuance and that this matter should have been heard on November 25, 2013 and not tabled at <br /> that time. If the Commission is so inclined to continue this matter, legal counsel would like to <br /> request a special meeting within one (1) month. Mr. Milligan's colleague is Joseph George and is <br /> present. <br /> Legal Counsel Bryan O'Malley noted for the record that the request to remove the candidate's name <br /> from the eligible list was not before the Commission at this November meeting, the request came <br /> after the November meeting. Mr. O'Malley recommended January 13, 2014 for continuing this <br /> matter. <br />
