#33 did not answer question #9 on the application regarding if he has a current Driver's <br />License. The applicant did supply a copy of his Driver's License; therefore, he is okay to <br />take the test. <br />V. NEW BUSINESS: <br />Human Resources Director C. Farver made a request to the Civil Service Commission regarding <br />revising the language in the rules for promotional testing to require that an employee applying for a <br />promotional position is "an employee in good standing." The Assistant Law Director B. O'Malley <br />will look into this matter and draft the language. He also recommends amending the rules at the <br />right time and in advance of any promotional exams. In addition to amending the rules, the <br />Commission might want to create a greater definition of an applicant's record check for entry <br />levels. If an applicant is going to be rejected there should be a very clear reason for the rejection. <br />Mr, O'Malley added that the Commission might consider open and competitive testing for the <br />Police Chief's position. A general discussion followed regarding previous discussions for open and <br />competitive testing for the Police Chief and the success of the open and competitive process for the <br />Fire Chief's position. The Administration has seen the leadership changes that have occurred in the <br />Fire Department and was very satisfied with the process. Mr. O'Malley will draft the language. <br />The Commission's packet contained a post card from the Common Pleas Court regarding Brian <br />Bielozer's appeal to the Civil Service Commission. Mr. O'Malley advised that there was a <br />telephone conference scheduled for May 141" that was cancelled as unnecessary because the briefing <br />schedule has been laid out by court, The appellant's brief is due on June 4"', the City's brief on <br />June 27t"; the appellant is given the opportunity to reply on July 11"' and then the court' issued <br />another post card indicating a telephone conference on June 18`x', but it might be cancelled. These <br />matters are usually handled through the exchange of briefs. Mr. O'Malley stated he has rarely seen <br />the court summon the parties down for an oral argument; however, the court could do that. The <br />court functions like an appellant body and is routine and the Commission is like a trial court. The <br />Commission is a decision making body. The Commission's decision on the Civil Service matter is <br />separate and independent from any other cases that have been filed by that particular candidate. <br />VI.
