• The use shall be located at least 3,000 feet, measured lot line to lot line, from the nearest <br />tattoo, branding, hookah lounge, drug paraphernalia, smoking establishments. <br />• The use shall be located within a commercial shopping center building with the combined <br />floor area of all businesses being 30,000 square feet or more. <br />The proposal does not meet the requirement for spacing and separation between like uses. The <br />new location will be approximately 535 feet from Cheap Tobacco (24363 Lorain Road) and <br />approximately 2,910 feet from Vitrum Glass Gallery & Smoke Shop (25193 Lorain Road), both <br />of which sell vaping products. However, this business existed before the zoning code update in <br />2017 that created these spacing requirements, so it is not adding a new smoke/vape shop to the <br />district. The relocation brings the business into greater compliance with the zoning code. The <br />current location is approximately 372 feet from Vitrum Glass Gallery and 1,790 feet from Cheap <br />Tobacco. In regards to the second specific conditional use factor, the applicant will also come <br />into conformance by relocating the use from a small, single retail space to a shopping center of <br />more than 30,000 square feet. Ms. Lieber recommended approval of the conditional use permit <br />with the recommendation that the Planning and Design Commission and City Council waive the <br />spacing and separation requirement as this is an existing North Olmsted business and that the use <br />is coming into greater conformance with the zoning code. Mr. O'Malley noted that the <br />conditional use at 25021 Lorain Road should be terminated as part of the approval. <br />Mr. Bercu said he has tried to diversify and upgrade the tenants in the plaza. The business owner <br />is a North Olmsted resident. The business is strictly a vape store and does not sell tobacco, <br />hookah or rolling papers. The owner has great reviews on Yelp and he feels like it would be <br />beneficial for the area to bring the business to the plaza. Mr. Yousef said he started the business <br />in 2014 and he is against smoking. He does not allow tobacco or other products in his store and <br />he tries to help people stop smoking. <br />Mr. Anderson moved, seconded by Mr. Rerko, to recommend approval of the conditional <br />use permit for 19-13016; JoJo's Smokeless World; 24137 Lorain Road with the <br />recommendation that City Council waive the conditional use standard for spacing and <br />separation and with the following conditions: <br />1. The existing location at 25021 Lorain Road will not be used as a vape store <br />2. Both properties are zoned A -One Family <br />Residence. The resulting property configurations of the two parcels will conform to our zoning <br />code. The split will not create any non -conformities with the current residential parcel. The <br />minimum lot size and lot depth will be met.
