He thought the fence that is proposed would resemble a barricade and other neighbors would <br />want to build additional fences. <br />Mr. Winkler, 25221 Sunset Oval, was concerned about installing a wooden stockade fence on the <br />property and thought it would destroy the layout of the neighborhood. The residents enjoy the <br />wildlife in the area. <br />Councilwoman Hemann did not think the neighbors object to the applicant's safety concerns but <br />are very concerned about the aesthetics of the oval. She brought up the 2015 BZA case at 5770 <br />Canterbury where the resident requested a higher fence and they were not permitted to have all <br />of the variances. She thought there is some responsibility of the home owner to train their dog in <br />addition to having a fence installed. <br />Mr. Campbell, 5380 Sunset Oval, was opposed to a solid fence as it would ruin the integrity of <br />the neighborhood. There are no fences in the oval and he would like to keep it that way. <br />Mr. Oergel, 5414 Sunset Oval, suggested using more landscaping in addition to a shorter fence. <br />Mr. Diehl, 25127 Sunset Oval, pointed out that the home on the opposite side of the oval, has a <br />shorter fence with hedges. He said the neighborhood is very quiet and there is not much traffic. <br />Mr. Aspery pointed out that a variance would be needed if the applicant wants to have a six-foot <br />fence less than 20 feet from the right of way. It is the property owner's responsibility to prove <br />where the property line is. Mr. Gareau said the applicant should not use the GIS information to <br />determine property lines, but a surveyor should identify where the lines are. Mr. Aspery added <br />that each case is looked at separately and the code has changed since the case at 5770 Canterbury <br />Road was heard by the BZA. He said when the code was changed it reduced setbacks from 50 to <br />20 feet to allow more room to be fenced in the back yard of corner lots. He said the neighbors <br />had valid concerns about the character of the neighborhood changing. Mr. Gareau pointed out <br />that three communications were received from Roman Barabach, Ernie Oergel and Florica Iova <br />and will be included in the casefile. <br />Mr. Mackey asked if there is a homeowners' association, Mr. Picone said there is not. Mr. <br />Papotto asked if the height of the fence noted includes the top of the arch, which it does. Mr. <br />Raig asked about the plat that was provided, Ms. Rambo -Ackerman said the issue was raised <br />prior to the meeting about an easement behind the applicant's property so the documentation was <br />provided. Mr. Gareau said a fence cannot be built in the recorded easement. Mr. Picone asked to <br />table the proposal and make some changes. Mr. Mackey understood the sentiments of the <br />neighbors.
