Proposal consists of a fence on a corner lot. Property is zoned C -One Family Residence. The <br />following variances are requested: <br />1. An 18 in. variance for height of a fence constructed on a corner lot in the side yard; code <br />allows fences up to 30 in. high, applicant shows 48 in., Section 1135.02(D)(3). <br />2. A variance for a solid fence constructed on a corner lot in the side yard; code requires fences <br />to be 50% open; applicant shows a solid fence, Section 1135.02(D)(3). <br />Note: A 6 in. fence setback from side street right-of-way is shown. <br />Mr. Aspery said the applicant is proposing to install a four -foot board -on -board fence in the side <br />yard of their home on a corner lot. Code states that a fence that is at least 50% open and that does <br />not exceed 30 inches in height may be constructed on a corner lot in the side and rear yards at the <br />street line. The applicant shows a solid, or 0% open, fence 48 inches in height. A six-inch <br />setback is proposed for this fence where a 20 foot setback would otherwise be required by code <br />for a fence of this height and opacity. <br />Mr. Thomas wants to install a four -foot fence to protect his children. The fence would be <br />installed along the sidewalk area, not the ditch. Mr. Papotto asked about the existing shrubs, Mr. <br />Thomas says the shrubs are his and will be removed and replaced with the fence. He added that <br />the fence will be a solid wood fence. Mr. R.aig estimated that there is about five feet between the <br />house and sidewalk. Mr. Papotto was concerned about the sight line for the neighbor to the east <br />to see pedestrians in the area. Mr. Mackey was concerned about having a fence inches away from <br />the sidewalk and the effects that would have on the neighbors' visibility. Mr. Mackey would be <br />more supportive of a fence that would be contiguous with the home. Mr. Thomas wants a solid <br />fence to protect kids walking by who reach in to pet a dog. Mr. Raig is not supportive due to the <br />location to the sidewalk and the visibility issues and pointed out that landscaping would not <br />require a variance. Mr. Thomas asked to table his proposal and make adjustments. <br />Mr. Papotto moved, seconded by Mr. Mackey, to table the proposal for 19-13600; Joseph <br />Thomas; 3183 Walter Road until the next meeting, motion passed 3-0. <br />19-13603; Ronald McNulty; 6029 Timber Trail Drive <br />Representatives: Ronald & Jacqueline McNulty, owners <br />Proposal consists of a building addition in the rear yard. Property is zoned B -One Family <br />Residence. The following variance is requested: <br />1. A 13 ft. variance for rear building setback; code requires dwellings to be set back at least 50 <br />ft. from the rear property line, application shows 37 ft.; Section 1135.06(D). <br />Mr. Aspery said the applicant is requesting a variance of 13 feet to allow for the addition of a <br />288 square foot sunroom to the rear of their existing home. The setback from the rear of the <br />house is currently 50 feet and the proposed addition would reduce this to 37 feet. Code requires a <br />rear building setback of no less than 50 feet. Mr. McNulty said they have lived in the home since <br />1993 and trees would prevent the addition from negatively impacting the rear neighbor. They <br />would like to add the improvement to the home to allow them to live in their home longer. Ms. <br />McNulty said the addition would extend the indoor and outdoor living space with the addition. <br />Mr. Mackey was in favor of the proposal, Mr. Raig and Mr. Papotto agreed. <br />
