Mr. Aspery stated that the applicant is proposing to replace their existing concrete and gravel
driveway with an all concrete driveway serving the detached garage. Code allows a maximum
width of 24 feet for a driveway in the side and rear yard and 12 feet in the front yard. The
applicant shows the driveway at a maximum width 26 feet 6 inches feet in the rear yard tapering
to 20 feet in the front yard, both of which dimensions require a variance. Mr. McKay said the
existing driveway is 17 feet wide and he wants to extend it to the edge of the garage. He can
barely put two cars next to each other in the current driveway. Mr. Mackey asked why the drive
was extended all the way to the street, Mr. McKay said he has a boat and trailer that he backs
into the driveway. The existing apron is 22 feet wide. Mr. Mackey understood the applicant's
request for a wider driveway since he has a trailer and believed it would improve the area
without affecting the neighborhood. Mr. Raig pointed out that an email was received from
Councilman Glassburn in favor of the proposal. Mr. O'Malley noted that residents can submit
letters for cases, so Council can do the same.
Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variance for 19-
14224; Sean McKay; 25112 Gessner Road:
1. A variance for width of a driveway serving a detached garage; code allows a maximum
width of 12 ft. in the front yard and 24 ft. in the side and rear yard, applicant shows a
width of 20 ft. in the front yard and 26 ft. 6 in. in the rear yard; Section
1135.02(B)(2)(c).
Motion passed 4-0.
19-14270; James Borsuk; 5170 Lucvdale Avenue
Representatives: James Borsuk, 30848 Lytham Circle, Westlake, OH; Jeff Borsuk, 5170
Lucydale Avenue; Paul Schumann, Ward 3 Councilman; Mary Ann Manley, 5257 Dover Center
Road and 5245 Dover Center Road
Proposal consists of an appeal of a Notice of Violation of the Building Commissioner. Property
is zoned B -One Family Residence.
The following appeal is requested:
1. An appeal of a Notice of Zoning Code Violation; applicant has wall signs located on a
property in a One Family Residence District; code does not permit; Section 1163.28. See
1163.08 Appeal.
Mr. Aspery stated that the applicant is appealing a notice of violation for the wall sign on their
garage. Wall signs are not permitted in residential districts according to Chapter 1163. James
Borsuk had photos of the garage as of July 1, 2019. Ms. Manley said she was pleased with the
garage being painted as of that morning. James Borsuk understood that there is one code
violation encompassing several items and he wanted to address each item separately. He believed
the main reason for the violation was the garage door. He had examples of other properties with
paint and designs on their doors. He felt that the image was done in good taste. Jeff Borsuk said
the garage had various forms of paint on the garage since he was in the process of re -priming and
repainting it. He planned to use various colors of paint to paint a mural on the garage door. He
looked at the codes and did not see any requirements for paint color. During the time of
maintaining the garage, he practiced his urban art on the sides of the garage to prepare for jobs
he was contracted to do. The trim and sides of the garage have been repainted since then. Jeff
