A 42 in. variance for height of a fence constructed on a corner lot in the side yard; code <br />allows fences up to 30 in. high, applicant shows 72 in., Section 1135.02(D)(3). <br />2. A variance for a solid fence constructed on a corner lot in the side yard; code requires fences <br />to be 50% open; applicant shows a solid fence, Section 1135.02(D)(3). <br />Note: A 10 ft. fence setback from side street right-of-way is shown. <br />Mr. Aspery stated that the applicant is proposing to install a 6 -foot vinyl privacy fence in the side <br />and rear yard of their home situated on a corner lot. Code states that a fence that is at least 50% <br />open and that does not exceed 30 inches in height may be constructed on a corner lot in the side <br />and rear yards at the street line. The applicant shows a solid fence 72 inches in height. A ten foot <br />setback is proposed while 20 feet would otherwise be required by code. Mr. Follen wants to <br />match the fence of the property behind him which is 10 feet from the right-of-way. He wants to <br />enclose his yard because he has a dog. Approximately six years ago, a piece of concrete went <br />through his window so he also wants the fence for privacy. Mr. Aspery said the Planning <br />Department takes the position that the code requirement was reduced from 50 feet to 20 feet and <br />the Board should keep that in mind. Mr. Papotto clarified that the proposed fence would be <br />allowed if it was 20 feet from the right-of-way, Mr. Aspery said yes. Mr. Raig pointed out that <br />the fence is proposed to go to the front of the home, not set back from the front like their <br />neighbor's. Mr. Raig asked if there was an easement in the rear of the property, Mr. Aspery did <br />not know. Mr. Papotto believed if the fence was shorter, it would be more palatable and he did <br />not see the hardship of the applicant since he could move it back 10 feet. Mr. Mackey preferred <br />to see the required setback observed. <br />Mr. Papotto moved, seconded by Mr. Raig, to approve the following variances for 19- <br />14218; Robert Follen; 6876 Warrington Drive: <br />1.
