BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF NOVEMBER 4, 2019 <br />ROLL CALL <br />Chairman Raig called the meeting to order at 7:05 pm in Council Chambers and led the Pledge <br />of Allegiance. <br />Present: Bob Papotto, Ralph Mackey, Eric Allain, Dan Rahm <br />Absent: Mike Raig <br />Staff. Law Director Michael Gareau, Jr., Assistant Building Commissioner Dan Russell, <br />Administrative Assistant Nicole Rambo -Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Mackey moved, seconded by Mr. Papotto, to approve the Building & Zoning Board of <br />Appeals minutes of October 7, 2019, motion passed 4-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />19-15411; Dorothy Brown; 5580 Porter Road <br />Representatives: Jeff & Dorothy Brown, owners <br />Proposal consists of a new garage. Property is zoned B -One Family Residence. <br />The following variances are requested: <br />1. A 3 ft. variance for side yard setback; code requires garages to be set back at least 5 ft., <br />applicant shows 2 ft., Section 1135.02(B)(1)(c). <br />2. A 7 ft. 7 in. variance for rear yard setback; code requires garages to be set back at least 10 ft., <br />applicant shows 2 ft. 5 in., Section 1135.02(B)(1)(c). <br />3. A 6.2% variance for excessive rear yard lot coverage, code permits 20% rear yard lot <br />coverage, applicant shows 26.2%, Section 1135.05(B)(2). Note: The rear yard is 55 ft. x 40 <br />ft. = 2,200 sq. ft.; 576 sq. ft. garage / 2,200 sq. ft. = 26.18%. <br />The applicant is proposing to construct a new 576 square foot garage in their rear yard. The <br />garage will encroach into the side yard by three feet and rear yard by seven feet seven inches. <br />While the garage size itself is compliant, the lot size only permits 440 square feet of rear lot <br />coverage; therefore a lot coverage variance is requested. Mr. Brown said they would like to <br />remove the current garage but it would be two feet wider and four feet deeper than the current <br />structure. If the garage is built five feet from the property lines, there would not be enough room <br />to drive a vehicle around the house to access the garage. The driveway would also need to be <br />reconfigured if the garage is moved into the property. Mr. Papotto confirmed that the existing <br />shed and garage will come down, Mr. Brown said the new garage will be in the same northwest <br />corner and will encompass the area occupied by the garage and shed. Mr. Brown stated that they <br />own the lot to the south but the two lots have not been consolidated. Mr. Mackey did not object <br />to the proposed improvement. Mr. Papotto pointed out that a letter was submitted showing that <br />the neighbors did not object to the proposal. <br />
