Mr. Mackey was in favor of the site plan. Mr. Papotto thought that the removal of the buffering zone allows the building and curb cut to be moved as far north as possible, thereby reducing their effects on the intersection. Mr. Allain believed the applicant justified the requested variances. Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variances for 19- 13405; Dunkin Donuts; 5581 Stearns Road, as amended: 1. A 13.83 ft. variance for required buffer zone (north property line); code requires buffer zone of 30 ft.; applicant shows buffer zone of 16.17 ft.; Table 1139.06-3. 2. A variance for 7 parking spaces; code requires a minimum of 49 parking spaces; applicant provides 42 parking spaces; Table 1161.03-1. 3. A variance for a flashing sign; code does not permit; applicant shows digital sign area on monument sign; Section 1163.23, conditioned that the sign copy be one color on a dark background and not be changed more than one time per day. The message may change at a greater frequency if the code is updated to permit more frequent changes. 4. A variance for 5 ground signs; code permits 1 ground sign per lot; applicant shows 1 existing sign and 5 new ground signs (monument sign, 2 directional signs, menu board and height limitation bar); Section 1163.27.A. Motion passed 5-0.
