BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES FOR MARCH 1, 2021 <br />ROLL CALL <br />Chairman Allain called the meeting to order at 7:00 pm via online public meeting. <br />Present: Eric Allain, Bob Papotto, Suzie Patton, Ralph Mackey, Dan Rahm <br />Staff. Planning Director Kim Lieber, Law Director Michael Gareau, Jr., Administrative Assistant <br />Nicole Rambo -Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Papotto moved, seconded by Ms. Patton, to approve the Building & Zoning Board of <br />Appeals minutes of January 4, 2021, motion passed 5-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />21-18488; Christopher McNamara; 4369 Brendan Lane <br />Representative: Christopher McNamara, owner <br />Proposal consists of a new deck and pool. Property is zoned C -One Family Residence. <br />1. A 4 ft. variance for side yard setback; code requires pools to be set back not less than 10 ft. <br />from a side lot line, applicant shows 6 ft., Section 1135.02(I). <br />2. A 5.3% variance for excessive rear yard lot coverage; code permits up to 20% (1,352 sq. ft. <br />based on rear yard area of 6,760 sq. ft.), applicant shows 25.3% (1,710 sq. ft.), Section <br />1135.05(B)(2). <br />The applicant proposes to construct a pool in the rear yard. Pools and associated decks must be <br />set back at least ten feet from any side or rear property line. The pool is proposed to be set back <br />ten feet; however, the deck is shown at six feet from the property line, resulting in the side yard <br />variance of four feet. Also, the pool and deck contributes to additional rear yard lot coverage. <br />The code permits 20% rear yard lot coverage and the pool, in addition to the existing patio and <br />shed, results in lot coverage of 25.3%. Mr. McNamara said the pool has already been installed <br />under a separate permit and now they would like to install a deck around the pool. He thought <br />the pool setback requirement was ten feet and the setback for the deck was six feet, so that is <br />why the pool is located where it is. Ms. Lieber thought the impact to the neighbors would be <br />reduced because of the fence and the amount of green space in the rear neighbor's yard. Mr. <br />Papotto asked if the fence would be removed, Mr. McNamara said the vinyl fence was installed <br />last year so there are no plans to remove it. Mr. Papotto thought the deck will be a great addition <br />to the property. Mr. Allain agreed and thought the width of the lot was a hardship. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variances for 21- <br />18488; Christopher McNamara; 4369 Brendan Lane: <br />1.
