was set back approximately 17 feet from the back edge of the sidewalk. The property line <br />roughly follows the back of sidewalk, so the encroachment is estimated at three feet. Mr. Thall <br />said permits were pulled and the email from the inspector regarding the setback requirement was <br />not received. They usually install fences 16 feet from the sidewalk according to the Ohio <br />Building Code. He did not think there was anything affecting visibility for neighbors and there <br />would be a substantial length of fence that would need to be moved. His company is relatively <br />new and learning that communities may have different zoning regulations. Ms. Lieber was <br />disappointed that the fence was installed improperly but thought it was a relatively small <br />deviation. Mr. Allain asked how long he has had his fence business, Mr. Thall said his company <br />has been in the fence business for about nine months but has had a renovation business for 28 <br />years. Mr. Thall said the email to Michelle Thall was missed but he would have complied if he <br />had received it. Mr. Allain does not like when applicants do work and ask for forgiveness later <br />but he does appreciate the contractor being at the meeting. That being said, he recognized it was <br />a small variance request, Mr. Rahm and Mr. Papotto agreed. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variance for 21- <br />18504; Joseph & Carrie Albrecht; 3956 Dryden Drive: <br />1. A 3 ft. variance for the setback of a fence in the side and rear yard of a corner lot; code <br />requires 20 ft., applicant provides 17 ft., Section 1135.02(D)(3). <br />Motion passed 5-0. <br />COMMERCIAL APPEALS AND REQUESTS <br />21-18351; Sheetz; 24400 Lorain Road <br />Proposal consists of a new service station and car wash. Property is split zoned B-1 Local <br />Business District and B -One Family Residence. <br />1. A 89.6 ft. variance for maximum front building setback for the c -store; code allows up to 65 <br />ft., applicant shows 154.6 ft., Table 1139.04-3. <br />2. A 27.4 ft. variance for maximum front building setback for the car wash; code allows up to <br />65 ft., applicant shows 92.4 ft., Table 1139.04-3. <br />3. A variance for excessive lighting along a sidewalk, entrance or pedestrian area; code permits <br />12.5 fc at any one point, applicant shows 15.0 fc, Table 1161.10-2. <br />4. A variance for excessive lighting under a service station canopy; code permits a maximum <br />average of 15.0 fc and a maximum at any one point of 20 fc, applicant shows 18.91 fc <br />average and 30.0 fc max, Table 1161.10-2. <br />5. A variance for maintaining lighting levels between 11:00 p.m. and 7:00 a.m.; code requires a <br />reduction in lighting between 11:00 p.m. and 7:00 a.m., applicant proposes to maintain <br />lighting levels, Section 1161.10(F). <br />Prior to the meeting, applicants requested the proposal be tabled until the April meeting. <br />Mr. Rahm moved, seconded by Ms. Patton, to table 21-18351; Sheetz; 24400 Lorain Road <br />until the next meeting, motion passed 4-0, Mr. Papotto abstained. <br />ADJOURNMENT <br />
