See also 1135.06(D). <br />The applicant proposes to install a roofed structure over an existing patio in the rear yard. Code <br />requires any deck or patio attached to the principal dwelling to meet the setback requirements of <br />the dwelling. The cover will be located 38.7 feet from the rear property line, where 50 feet is <br />required, so the patio will encroach by 11.3 feet. Staff did not find any variances on file for the <br />location of the patio. Mr. Henry has an existing patio that he would like to have Bright Covers <br />install an awning over. It will attach to the house and anchor into the patio. Ms. Lieber had no <br />concerns about the proposal. Ms. Patton asked what the setback of the back of the house is, the <br />owner was unsure but the patio would extend a little past the existing patio. Mr. Henry said that <br />no additional patio area would not be added and landscaping would replace the bricks in front of <br />the concrete slab.
