BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF JUNE 7, 2021 <br />ROLL CALL <br />Vice Chairman Papotto called the meeting to order at 7:00 p.m. via online public meeting. <br />Present: Bob Papotto, Ralph Mackey, Dan Rahm <br />Absent: Eric Allain, Suzie Patton <br />Staff. Planning Director Kim Lieber, Law Director Michael Gareau <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Rahm moved, seconded by Mr. Mackey, to approve the Building & Zoning Board of <br />Appeals minutes of May 3, 2021, motion passed 3-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />21-19338; Dennis Beno; 4708 Porter Road <br />Representative: Dennis Beno, owner <br />Proposal consists of a fence on a corner lot. Property is zone B -One Family Residence. <br />1. A 12 ft. variance for the setback of a fence in the side and rear yard of a corner lot; code <br />requires 20 ft., applicant shows 8 ft., Section 1135.02(D)(3). <br />Note: The proposed fence is a 6 ft. high solid board fence. <br />Ms. Lieber said the applicant proposes to construct a solid 6 -foot high fence in the rear yard of <br />their corner lot. The lot fronts on Porter Road with driveway access from Wisteria Drive. The <br />fence will begin west of the driveway and will be located 8 feet from the property line at the <br />closest point; therefore, a 12 -foot setback variance is requested. Mr. Beno said he would like to <br />better contain his yard for children and pets and add privacy on his corner lot. Ms. Lieber said <br />the setback regulations exist to preserve sight lines and for public safety; however, the fence <br />would not pose any more of a visual obstruction than the existing vegetation along the sidewalk <br />on both the applicant and neighbor's property. Mr. Mackey thought the fence angle at the <br />driveway would ensure adequate visibility for vehicles and that the plan seemed reasonable. Mr. <br />Rahm agreed. Mr. Papotto observed the treelawns are wide which sets the fence back even <br />further from the street and that given the lot configuration, only a limited area would be fenced. <br />Mr. Mackey moved, seconded by Mr. Rahm, to approve the following variance for 21- <br />19338; Dennis Beno; 4708 Porter Road: <br />1. A 12 ft. variance for the setback of a fence in the side and rear yard of a corner lot; <br />code requires 20 ft., applicant shows 8 ft., Section 1135.02(D)(3). <br />Motion passed 3-0. <br />COMMERCIAL APPEALS AND REQUESTS <br />21-18812; DASHE, LLC; 31441 Lorain Road <br />
