A 6 ft. variance for a detached garage located too close to a dwelling; code requires 15 ft., <br />applicant shows 9 ft., Section 1135.02(B)(1)(c). <br />The applicant is proposing to add on to their existing 440 square foot garage. The addition will <br />be 360 square feet, requiring a variance of 50 square feet for total garage area. The applicant is <br />also adding on to their home. The addition proposed will shrink the distance between the house <br />and garage. Fifteen feet is required minimum spacing, the proposed spacing is nine feet, resulting <br />in a six-foot variance request. Ms. Wallace purchased the home using a mortgage rehab <br />construction loan and they are looking to build an addition and turn the existing two -car garage <br />into a four -car garage. The only place an addition could be built is on the rear of the home, but it <br />would be too close to the garage. She was unaware of the code requirements when they got the <br />appraisal done for the loan. Ms. Lieber thought the spacing requirement may have to do with <br />maintaining access in and around the structure. However, there are instances of homes being <br />attached to garages through breezeways, Ms. Patton agreed. Mr. Papotto added that any other <br />building code issues will be addressed during the permit review process. Mr. Allain was <br />concerned about the lot size and the proximity to the neighbors. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variances for 21- <br />2129; Kyle & Kara Wallace; 5873 Barton Road: <br />1. Property is zoned B -One Family Residence. <br />1. A variance for a second storage building on a residential lot; code permits one, applicant <br />shows two, Section 1135.02(C)(2). <br />Note: Applicant has an existing 10 ft. x 14 ft. (140 sq. ft.) shed. Proposed shed is 12 ft. x 16 ft. x <br />11 ft. high (192 sq. ft.). Lot is 41,553 sq. ft. <br />The applicant is requesting a variance for a second shed. Only one accessory storage structure is <br />permitted on a lot. Ms. Young is proposing an additional shed to be used as office and workout <br />space. The space where the shed would be installed is not utilized and the existing shed is used to <br />store lawn equipment. Electrical and water access are already in the area to build the additional <br />living space. Ms. Lieber pointed out that any commercial use of the structure would need to <br />comply with the home professional office regulations which require everything to be in the main <br />dwelling, Ms. Young said it will only be for personal use. The additional space is needed <br />because they have two people working from home and it is becoming cluttered. Mr. Papotto <br />confirmed that the space will be heated since it would be used year-round, Ms. Young said it <br />would be. Ms. Lieber said a slightly bigger shed would be allowed if the lot was more than one <br />acre, but a variance would still be required for a second shed. <br />
