A 3 ft. 6 in. variance for height of a is <br />in the front yard: code allows a fence in the <br />front yard not to exceed 30 in., applicant shows 6 ft., Section I I35(D)f2). <br />2. A 50% variance for an opaque fence in the front yard; code allows a fence in the front <br />yard not to exceed 50% opacity, applicant shows 100%. Section 1 I35.02(D)(2). <br />Note: The proposed fence will be installed along the side property line. The 22 ft. long portion <br />that extends beyond the house is located in the front yard. <br />Ms. I.ocigno stated that the 22 feet is for privacy and aesthetics. They moved in three years ago, <br />and have installed all new landscaping. Looking for more privacy. Mr. Antonucci stated that <br />they chose to have a 6 foot fence instead of what the code allows for more privacy. He <br />submitted pictures to the board showing the before and after images of the improvements that <br />have been made to the home. <br />Mr. Phillips, 24379 Rosita Lane, commented that when he looks up and down Rosita Lane he <br />does not see any 6 -foot privacy fences that extend in the front of the homes. Ile Likes the idea of <br />having a 6 -foot fence along the back and side yards but does not like the idea of having a fence <br />in the front yard. <br />Mr. Schmidt, 24400 Rosita Lane. wanted to know why a permit was not issued before the fence <br />was put up. Mr. Antonucci responded that he was out of town for a couple of days and he had <br />the fence material in the backyard and his cousin decided he was going to surprise him and when <br />he returned he was upset and stopped the project immediately. Ms. Seeley commented that she <br />spoke to Mr. Antonucci and he recently came in and applied for a building permit and it is <br />pending on tonight's outcome and it looks that what has been installed is the 22 feet. She added <br />that he knew his cousin should not have started installing the fence without a permit. Mr. Rahm <br />asked the building department is the fence he observed is the finished project? Ms. Seeley <br />answered that it k not completely finished and the section that was put up in the front yard is <br />what is in question_ Mr. Rahm asked that the two sections of the fence that are up right now, the <br />post that is closest to the street is that as far as the fence will be? Mr. Antonucci said yes and then <br />it would extend to the backyard. <br />Mr. Mackey commented that at first he believed the fence would extend much further to the <br />street however after viewing the property, clarification from the applicant and observing what <br />has been installed he is okay with the request. Ms. Patton stated that it is a difficult decision <br />when the work has already started. Her concern is with the height of the fence in the front yard_ <br />
