City In2ineer Pictro DiPrancu <br />REVIEW AND CORRECTION OF MINI 1 ES <br />Ms. Nader mused, seconded he Mr. Anderson, to approve the Planning & Design <br />Commission minutes ofdune IIA, 2f122, motion passed 5-0. <br />NEW BUSINESS <br />22-21489; Arbv's; 26324 Lorain Road <br />Represenlalives: Brian Wellert. Wellen Corporation, X136 Beach Road Medina. O11: David <br />Skidmore.Jnspire Brand Restaurants. Lewis Center. UH <br />Proposal consists of redevelopment of an existinghacant retail building into Arby s fast-food <br />restaurant Property is zoned B-3 Gcncral Business. <br />the proposed Arby's project is yen similar to the project that ryas approved by the Planning and <br />Design Commission in 3019. I loweccr. due to the pandemic the project was put on hold and all <br />permits associated with the project expired. lheretbre, the applicants must undergo the entire <br />desclopment plan reicw. <br />Director Lipton. presented the project and noted a few updates that NNere added from the 2019 <br />design. The first was the addition of two menu boards as opposed to one and second, the placement <br />of the dumpsters. <br />Cih Iingineer, Pete DiPranco commented that these plans tNerc previoush approved in 11019. In <br />the beginnin_ of 2000 he was working with the Arby's representatives to pull permits hoNNeyer the <br />project was put on hold due to the pandemic Mr. Dil ranco stared that the engincering department <br />dues not have any issues wilt the submitted plans. <br />Assistant Law Director O Nfallcy stated that he was unable to locate the deed restriction that was <br />referred to in the 2019 meeting minutes. Ile explained that in 2019 he adyisd the commission that <br />the board members did not ImNe to take am u <br />action n the decd restriction and it was up to council. <br />He noted that this is still true huwecer he would noNN advise that the hoard makca recommendation <br />to council to amend the deed restriction. He belicNes that additional legal research needs to be <br />done in order to uncoNer the deed restriction and the proper steps that need to be taken in order to <br />
