Motion by Ms. Nader, Second, by Mr. Anderson that the Planning and Design Commission <br />recommends to city council an initiative to a proposed legislation change of the definition <br />apartment. The definition of apartment means a multi -family dwelling comprised of three <br />(3) or more dwelling units arranged side by side and / or one above the other, and each having <br />a separate entrance or entrances connected to a common outside entrance or entrances. This <br />definition would replace the current definition. Second, the board recommends an addition <br />to include townhouse since it is not currently defined in the code. Tour nhouse means a multi- <br />famih dwelling comprised of at least three dwelling units attached by common fireproof <br />walls each unit having at least two separate exterior entrances on the ground floor, n ith no <br />common lobby, finer or similar halhvav serving more than one apartment. Included are <br />townhouse types such as atrium house, patio house, row house and attached single-famik <br />dwellings. II was concluded that we do not have the abilitc to <br />approve. Director I Ipton sat dmvn with Law Director (iareau to discuss and referred to the <br />existing pieces of the code. The proposed language is almost taken twrd from word from the <br />multiple residence section of the code. ( urrentl, iI)ou are a multi -family developer and you <br />want to do three phases ofupartment buildings. ,ou can get approval for all three phases at one <br />Time. but if<ou are doing a siuniticant deselopment in a husiaess Toning clasaitication. there is <br />no mechanism in our code to allow for the approval of a phase development project. Director <br />I pton, continued that we want to attract lamer scale deselopment and those developers typically <br />want approval if thes're project is going to -W in subsequent phases. Ms. Nader stated that the <br />legislative request form identifies phase development in the business zoning district. Ms. Nader <br />asked if she is presenting this board approval^. Mr_ Upton answered yes. If the hoard approves <br />the definition as written. then it will be presented hack to cit, council tura third readine for final <br />consideration. <br />Motion by Ms. Nader, second by Mr. Anderson to approve this definition with for the <br />ordinance number 2022-26. regarding the phase development of the business zoning <br />district of the City of North Olmsted and to recommend to Cit, Council for further <br />processing. <br />Motion passed 5-0. <br />
