The driveway variance shall be legally effective as of the date the city issues the applicant <br />permits for construction of the project as presented to the board on permanent parcel number <br />237-19-037 and 237-19-024; further subject to the requirement that any event that on or before <br />December 31, 2024 applicant has not applied for and received permits from the city to proceed <br />with construction on permanent parcel number 237-19-037 and 237-19-024 and construction has <br />not commenced by that date then this decision shall be held for naught and shall thereafter be of <br />no legal force and effect. Thirdly that the access drive as discussed and presented leaves in <br />conceptually tonight for the use variance parcel shall not exceed 24' in width and centered on the <br />parcel as has been presented this evening.
