trees located on the tree lawns of 25320 and 25315 Clubside Drive. <br /> Representative: Lois Weingarden, 25505 Country Club Blvd. Unit 6 <br /> Marie Ordner, 25505 Country Club Blvd. Unit 5 <br /> Director Upton explained to the board the reason that a tree removal was submitted to this board <br /> for review. He stated that this was a"Multi-Family" tree and per the code no one is to remove <br /> this tree without expressed approval from this body. Director Upton stated the application was <br /> reviewed and there were no objections of the removal and replanting of the trees. There was one <br /> outstanding question, however; there was nothing discerned of the typology of the tree and <br /> whether it comports with recommended planting within our code. <br /> Ms. Weingarden explained that they were unaware it was required to apply and go in front of the <br /> board regarding the removal and replanting of trees. She stated they already removed three trees <br /> due to the issue of the roots affecting the drainage system, that was recently fixed. They made <br /> the decision to plant trees in the front, away from the drains, so they would not have any further <br /> issues. A resident of theirs donates money every year to plant new trees, and they would like <br /> permission to plant at least five trees this year. <br /> Director Upton asked to speak to the applicant. He advised that the new zoning code was <br /> adopted in 2017, so some rules may have changes. He explained that they, (the HOA), did not do <br /> anything wrong, but after reviewing the documents and referencing the code, he didn't have the <br /> authority by law to sign off on the request, unless the board was ok with it. <br /> Ms. Hemann explained in support of the applicant that often, they were never notified of these <br /> changes. Also, some parts of development may not be affected while others would be. She also <br /> stated that the trees were ornamental and have grown too large for the property, which is a <br /> common issue when properties continue to develop. She expressed she was in favor of this issue. <br /> Mr. Olivos asked what types of trees they were going to plant, the representative stated they <br /> decided on fir trees. Mr. Olivos then asked if they went through a landscape company. <br /> Representative stated yes. <br /> Mr. O'Malley offered a historical explanation of the origin of the ordinance, and also <br /> recommended approval from the board. <br /> Ms. Ordner asked if they will be required to come before the board each time they want to <br /> remove or plant. Director Upton explained that this ordinance will be getting a closer look this <br /> year. Ms. Hemann asked Dir. Upton if there was any waiver process for one or two trees. Dir. <br /> Upton stated the ordinance did not allow for that at this time; however; upon taking a further <br /> look into this ordinance he would like to bring something to the council. Ms. Hemann spoke to <br /> the applicant that after a cleanup of the ordinance, she hopes the process will be fairly easier. <br /> Ms. Weingarden asked if they will have to change their HOA bylaws.
