Motion passed 4-0. <br /> 22-21179; Low Cost Pharmacy; 26901 Brookpark Rd. Extension <br /> Proposal consists of a pick-up window. Property is zoned B-4 Mixed Use Business. <br /> Representative: Leon Sampet 22082 Lorain Rd. Fairview Park, Ellis Architects <br /> Mr. Anderson stated this was previously brought before the commission on Sept. 14, 2022. This <br /> was a submittal with changes to address items then. <br /> Director Upton explained there was a lot of work done, which included four or five iterations of <br /> parking and stacking configurations. The final review recommended this configuration was <br /> acceptable. He stated that technically this could have been approved administratively; however, <br /> he felt it should be brought in front of this commission in a public forum. <br /> Mr. O'Malley suggested all to reference 1126.07, which is develop and review criteria. This <br /> outlines significant or potential adverse effects surrounding the proposal. This would include <br /> minimizing hazards, traffic circulation, storm water, landscaping, buffering, lighting, utilities <br /> services, emergency access, etc. <br /> Leon Sampet explained the previous plans showed the stacking lane at the rear of the property <br /> and was seen as a congestion hazard. The final decision was to try and work with the existing <br /> parking lot and to keep this traffic out of cross traffic ad still provide and escape rought and a <br /> drive-thru area. Parking requirements were calculated to be 86, which is what is provided. Mr. <br /> Anderson stated he remembered the initial plan and this is much improved. <br /> Mr. Anderson moved, seconded by Mr. Olivos, to approve 22-21179; Low Cost Pharmacy; <br /> 26901 Brookpark Rd. Motion Passed 4-0 <br /> 22-23456; Star-West Great Northern Mall, LLC, 5100 Great Northern BLVD <br /> Proposal consists of a lot split of permanent parcel number 236-09-003. Property is Zoned B-3 <br /> General Business. <br /> Mr. Anderson stated that there wasn't a representative present for 22-23456 and that it was to be <br /> tabled. Director Upton explained that was partially correct and wanted to provide an update. <br /> Under direction from the Director of Law Mr. Gareau, they were to reach out to the applicant <br /> and obtain consent to table the matter. Correspondence was received from an opposing counsel <br /> who registered and objection. The attorney that represents R6 Motors Inc. asked to include the <br /> objection of the lot split as part of the record. There is a restricted access agreement that governs <br /> the site itself between the principle mall property and all of the department stores are their own <br /> parcels. Bridge 33 is a part of the REA Home Depot Plaza. Opposing counsel sees it that the lot <br /> split violates some of the terms and conditions of that particular easement. The rejection was <br /> received the day prior and had not been studied. Due to that, Director Gareau requested to gain <br /> 1 <br />
