PLANNING & DESIGN COMMISSION <br />CITY OF NORTH OLMSTED <br />MINUTES OF SEPTEMBER 14, 2022 <br />ROLL CALL <br />Ms. Nader called the meeting to order at 7:06 pm. <br />Present: Julie Nader, Dave Anderson, Humberto Olivos, Tom Patton <br />Absent: Mary Ellen Hemann, Darrick Matthews <br />Staff: Economic & Community Development Max Upton, Assistant Law Director Bryan <br />O'Malley, Administrative Assistant Kristine Jones <br />REVIEW AND CORRECTION OF MINUTES <br />Ms. Nader moved, second by Mr. Patton to approve the Planning & Design Commission <br />minutes of August 24, 2022 <br />NEW BUSINESS: <br />22-22724; Brick City Vapors; 28875 Lorain Road <br />Proposal consists of a conditional use permit. Property is zoned B-2 Office/Service Space. <br />Representative: Keith James, 28875 Lorain Road. <br />Director Upton explained that Brick City Vapors has been in business since 2014 and has recently <br />changed building locations from Brookpark Extension to 28875 Lorain Road. They fall under the <br />new zoning code which requires a conditional use permit for the sale of tattoo, body branding, <br />hookah lounges, drug paraphernalia and smoke shops. In order to obtain a conditional use, permit <br />the following needs must be met: <br />1. The use shall be located at least 3,000 feet, measured lot line to lot line, from the nearest <br />tattoo, branding, hookah lounge, drug paraphernalia, smoking establishments. <br />2. The use shall be located within a commercial shopping center building with the combined <br />floor area of all businesses being 30,000 square feet or more. <br />Director Upton continued and the smoke shop is at least 3,000 feet from the closest tattoo, <br />branding, hookah lounge, drug paraphernalia, smoking establishments. He noted that the only <br />tattoo business within 3,000 feet from 28875 Lorain Road has been shut down. Also, the applicant <br />provided evidence that the use is located within a commercial shopping center building with a total <br />floor area of 30,000 square feet or more. He noted that both criterion has been met. Furthermore, <br />for the record it was noted that Brick City Vapors only sells vapors. <br />Ms. Nader stated that there is a significant amount of signage in the windows. Mr. James explained <br />that 33 % of window signage is allowed and they are right at that amount. He noted that they could <br />remove part of the sign that says `'vapors" if that would make the board feel more comfortable. <br />
