Motion by Ms. Nader, second by Mr. Anderson to approve the conditional use permit and to <br />approve the site plan that is presented and submitted for Enterprise Holdings at 27200 <br />Lorain Road, with the following condition: <br />1. To add a new gate for the for the dumpster enclosure per code. <br />Motion Passed 4-0. <br />22-21179; Low Cost Pharmacy; 26901 Brookpark Rd Extension <br />Proposal consists of a pick-up window. Property is zoned B-4 Mixed Use Business. <br />Representative: Bruce Abuahalil, 26901 Brookpark Road extension <br />Director Upton explained that he has been working with the applicant since January and has not <br />felt comfortable approving the plans as an administrative review. Therefore, pursuant to North <br />Olmsted Codified Ordinance 1126.03(B)6 (Below) Director Upton will be referring this matter to <br />Planning Commission and City Council for approval or denial. <br />1126.03 (B) 6: <br />B. Administrative Review. The Planning and Development Director shall review development <br />plans in connection with the creation of a use or the erection of a building or structure in any of <br />the following circumstances: <br />6. When, in the opinion of the Planning and Development Director, a project which otherwise <br />qualifies for administrative development plan review may have an impact on surrounding <br />properties, he/she may, in their sole discretion, submit the development plan to City Council for <br />review. <br />Director Upton commented that he and the engineering department have significant concerns <br />regarding the stacking of the vehicles and its impact on surrounding properties. <br />City Engineer Pete DiFranco also described his concerns with the required stacking spaces for the <br />drive-through, the code requires three spaces for each window. He noted from the site plan these <br />spaces would be located in a drive lane of the opposite direction of cars. He believes it would have <br />an adverse effect on circulation throughout the site. <br />Mr. Bruce Baum explained that they are proposing to add a pick-up window to the east side of <br />their building. He asked the board what type of concerns they had regarding the traffic flow. He <br />stated that they eliminated parking spots so cars would have more room to back up and they have <br />the required amount of parking spaces. Mr. Abukhalil, commented that the cars usually only wait <br />about a minute or two to pick up their prescriptions and the cars are not normally stacked because <br />of the quick process. He commented that this is his sixth pharmacy that he has opened in the <br />Greater Cleveland and Garfield area. <br />Assistant Law Directory O'Malley outlined to the board the development plan review criteria from <br />1126.07A as well as 1126.07 C; conditions of approval. He expressed that the board is under no <br />obligation to approve and their vote is a recommendation to city council. He also noted that the <br />90 parking spaces that Mr. Baum has referred to are shared spaces for all tenants. <br />
