BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MEETING MINUTES FOR JUNE 5, 2023 <br />ROLL CALL <br />Mr. Papotto called the meeting to order at 7:00 p.m. in Council Chambers. <br />Present: Bob Papotto, Ralph Mackey, Dan Rahm, Michael Kovach <br />Absent: Suzie Patton <br />Staff: Director Max Upton, Law Director Michael Gareau, Administrative Assistant Lyn Wilson <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Rahm moved, seconded by Mr. Kovach to approve the minutes from the February 6th <br />meeting. Motion passed unanimously. <br />RESIDENTIAL APPEALS AND REQUESTS <br />23-24257; Matthew Halun; 23818 Mastick Road <br />Representative: Matthew Halun 23818 Mastick Road <br />Mr. Upton explained the requested variance was for a 6 in. variance for height of a fence in the <br />front yard; code allows a fence in the front yard not to exceed 30 in., applicant shows 36 in., <br />Section 1135(d)(2). <br />Mr. Halun explained he wanted to install a scalloped white picket fence that was technically 36" <br />at its highest point 30-32" at its lowest point. Director Upton explained the applicant did request <br />a permit for the fence to surround the entirety of the property; however, upon an inspection from <br />the building department after the posts had been installed it was found that the owner had <br />installed the posts in the public right of way. Director Upton stated that the building department <br />and the city engineer were not recommending this variance to be approved. Mr. Halun explained <br />he misread the prints surrounding his property line and that he made a mistake. He further <br />explained that if he needed to, he would move the posts. Mr. Gareau suggested to the board that <br />if they chose to approve this variance the condition should be that the applicant abide by the <br />setback, due to the commission not technically having authority over the right of way. <br />Mr. Rahm made a motion; seconded by Mr. Kovach to approve; 23-24257; Matthew Halun; <br />23818 Mastick Road with the condition that the fence should not be constructed in and/or located <br />in the right of way. Amended to state "public" right of way. Motion was restated to include that <br />word by Mr. Rahm and seconded by Mr. Mackey. <br />Board members briefly discussed and all agreed the work the applicant is doing is an <br />improvement and understood the look of the scalloped picket fence. <br />Motion passed: 4-0 <br />
