Initially, the proposal was to use conditions from a specific code related <br />to traffic flow and distance from intersections. However, after a thorough review with the law <br />director, it was determined that a conditional use permit and a variance were necessary, as the <br />existing code did not explicitly allow for a drive-through at a general retail store. <br />The City Engineer confirmed that the site could accommodate three vehicles for stacking and <br />noted that there were adequate ADA access measurements, addressing concerns raised <br />previously. The office recommended approval of the permit with three conditions: the removal of <br />an LED lighting strip, some decorative items, and a bench from the front area. These conditions <br />aimed to ensure compliance with the approved plan. <br />The law director reiterated the process for reviewing conditional use permits, emphasizing the <br />need to assess potential adverse impacts related to site functionality, including buffering and <br />traffic circulation. He encouraged the commission to impose conditions that could be negotiated <br />with the applicant. <br />The applicant expressed willingness to comply with the conditions regarding the lighting and the <br />removal of certain items, although there was some discussion about relocating benches.
