CITY OF NORTH OLMSTED CIVIL SERVICE COMMISSION MEETING CITY COUNCIL CAUCUS ROOM MINUTES - JANUARY 27, 2025 7:00 P.M. I. ROLL CALL: Chair called the meeting to order at 7:01p.m. PRESENT: A. Flannery, J. Cotofan ALSO PRESENT: Public Safety Director J. Scofield, Human Resources Director L. Kidd, Assistant Law Director B. O'Malley, I -IR Administrative Secretary J. Davenport II. DISPOSITION OF MINUTES: Motion by Commissioner Flamiery, seconded by Commissioner Cotofan to approve the minutes of December 16, 2024 Motion passed unanimously. III. COMMUNICATIONS: There were 6 items of correspondence received and 37 items of correspondence sent out by the Civil Service Commission. IV. OLD BUSINESS: Police Captains Promotional Exam Result Protest Commissioner Flannery: So. The Police Captain's Promotional Exam Result Protest. We do not have a court reporter here today, so we are using the recording of our minutes, correct? Asst. Law Director O'Malley: Correct. And I think the record should reflect that was discussed off the record with the applicant and with other parties. And they all indicated a willingness to have the matter recorded without the presence of the court reporter. Madam Chair, I think it's important for the members to understand that this is somewhat of a formal hearing. Technically, the riles of evidence apply. The burden is on the applicant going forward. The applicant should be invited to state his case. If you're inclined to hear opening statements, those can be made. The applicant should be given every opportunity to present argument and evidence in support of his position. He can call witnesses if he wants to. Before you get started, there could theoretically be a separation of witnesses. If the applicant wants certain witnesses not to be in the room when other witnesses are being asked to give testimony. So it's almost like a miniature trial, if you will. The safety director is here on behalf of the city, but it's not like a plaintiff and a defendant.
