CITY OF NORTH OLMSTED <br />CIVIL SERVICE COMMISSION MEETING <br />CITY COUNCIL CAUCUS ROOM <br />MINUTES - JANUARY 27, 2025 <br />7:00 P.M. <br />I. ROLL CALL: Chair called the meeting to order at 7:01p.m. <br />PRESENT: A. Flannery, J. Cotofan <br />ALSO PRESENT: Public Safety Director J. Scofield, Human Resources Director L. Kidd, <br />Assistant Law Director B. O'Malley, I -IR Administrative Secretary J. <br />Davenport <br />II. DISPOSITION OF MINUTES: <br />Motion by Commissioner Flamiery, seconded by Commissioner Cotofan to approve the minutes of <br />December 16, 2024 <br />Motion passed unanimously. <br />III. COMMUNICATIONS: <br />There were 6 items of correspondence received and 37 items of correspondence sent out by the <br />Civil Service Commission. <br />IV. OLD BUSINESS: <br />Police Captains Promotional Exam Result Protest <br />Commissioner Flannery: <br />So. The Police Captain's Promotional Exam Result Protest. We do not have a court reporter here <br />today, so we are using the recording of our minutes, correct? <br />Asst. Law Director O'Malley: <br />Correct. And I think the record should reflect that was discussed off the record with the applicant <br />and with other parties. And they all indicated a willingness to have the matter recorded without the <br />presence of the court reporter. <br />Madam Chair, I think it's important for the members to understand that this is somewhat of a formal <br />hearing. Technically, the riles of evidence apply. <br />The burden is on the applicant going forward. The applicant should be invited to state his case. If <br />you're inclined to hear opening statements, those can be made. <br />The applicant should be given every opportunity to present argument and evidence in support of his <br />position. He can call witnesses if he wants to. Before you get started, there could theoretically be a <br />separation of witnesses. <br />If the applicant wants certain witnesses not to be in the room when other witnesses are being asked <br />to give testimony. So it's almost like a miniature trial, if you will. The safety director is here on <br />behalf of the city, but it's not like a plaintiff and a defendant. <br />
