Lieutenant Barrett:
Would you like us all to leave the room so you can discuss it on the record or if you want to discuss
in private you do have that option as Mr. O'Malley has stated.
Commissioner Cotofan:
Most of this is the first time I'm seeing it and the last time.
Asst. Law Director O'Malley:
You could take the matter under a transcript with the BZA to be fair. The proceedings was a judicial
body and this case cannot and must not be decided on anything other than you shouldn't be
communicating with any, I would even counsel except on the record.
Commissioner Flannery:
But no, I agree.
Asst. Law Director O'Malley:
One thing that worries me and one thing I would caution you against is you shouldn't reconvene and
start all over again. You shouldn't invite the parties back into your deliberations or start searching
for evidence that was never brought up or presented. Well, no.
It's not ever brought up or what was presented to any other method. And your third member won't be invited into the decision
making. Right.
Alright. So, you can tell them and excuse them. I'm sure that they don't necessarily want to stay
because you've got more agenda items.
Commissioner Flannery:
I do.
Asst. Law Director O'Malley:
Yes. Thant: you for coming up.
Dr. Borodkin:
Thank you so much for coming.
Commissioner Flannery:
Thank you very much.
Captain Angel Walling:
I appreciate it. Good to see you too. Good to see you again, sir.
Asst. Law Director O'Malley:
The commission meets on the third Monday and it's likely that they`ll have their decision and
announce it at that time. It'll be the fourth Monday.
Commissioner Flannery:
Oh, it's the fourth Monday? Okay.
Asst. Law Director O'Malley:
