to be provided from an existing main on Butternut Ridge Road, and the sanitary sewer system on <br /> Butternut Ridge Road was confirmed to have adequate capacity for the development. Stormwater <br /> drainage was designed to flow north toward the freeway, with no discharge to Butternut Ridge <br /> Road or adjacent properties. <br /> Traffic generation was evaluated using standard trip generation methodology. The development <br /> was projected to generate approximately 27 vehicles during the morning peak hour and 30 <br /> vehicles during the evening peak hour, with typical inbound and outbound traffic patterns.No <br /> significant traffic impacts were identified. <br /> The Commission's authority and duties under the City Charter were outlined, including its role <br /> in reviewing zoning and rezoning applications to promote the general welfare and providing <br /> recommendations to City Council. It was noted that while the Charter references adherence to <br /> the master plan, zoning decisions are ultimately legislative determinations by City Council and <br /> are not legally required to be consistent with a comprehensive plan. <br /> The mandatory referral process was explained, including the 30-day review period,the <br /> requirement to issue a report and recommendation, and the consequences of inaction. It was <br /> noted that a recommendation against rezoning would require a two-thirds vote of City Council <br /> for approval. <br /> Zoning authority was described as a police power that is presumed valid unless proven otherwise <br /> and must substantially advance public health, safety, and welfare. The proposed planned <br /> development district was characterized as a tool to allow higher-density single-family <br /> development in limited areas, while maintaining constitutional and legislative standards. <br /> Greg Sommers, Sommers Development Group, addressed the Commission and expressed <br /> appreciation for the opportunity to present. It was stated that the applicant had committed to <br /> considering feedback from the Commission, City administration, and the community. Based on <br /> the feedback received since the prior meeting,it was noted that additional adjustments could be <br /> made to address outstanding concerns. The applicant expressed support for tabling the item and <br /> indicated an intention to continue working with the project team and submit a revised plan for <br /> consideration at the November meeting. <br /> Public Comment <br /> Tammy Johnson,25769 Butternut Ridge Road, spoke in opposition to the rezoning, stating it <br /> conflicted with the Comprehensive Plan and the intent of the Historic District. It was noted that <br /> resident outreach and petitions reflected strong opposition and that development should instead <br /> be focused in designated commercial corridors. <br /> Robert Sharp,25407 Butternut Ridge Road, expressed concern that the proposal contradicted the <br /> Comprehensive Plan and further eroded the Historic District. It was stated that nearby high- <br /> density developments were past compromises and should not be used as justification for <br /> additional development. Traffic safety and neighborhood stability concerns were also raised. <br /> 2 <br />
