CITY OF NORTH. OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES -- JANUARY 7, 1987 <br />Chairman Remmel called the meeting to arder at 7:30 p.m, <br />Present: R. Bugala, R, Gomersall, B. Grace, J. Helon, and C. Remmel <br />Also Present: Law. Director Gareau, Building Commissioner S. Spino, and <br />Clerk of Commissions B. Oring. <br />R. Bugala moved to aceept the mi.nutes of December 3, 1986 as presented, <br />seconded by J. Helon, and unanimously approved. <br />Election of Officers: <br />R. Bugala moved to nominate Chester Remmel as Chairman for the Board of <br />Zoning Appeals for the City of North Olmsted, seconded. by B. Grace. <br />No otfier nominations were made. Roll call on motion: Bugala, Grace, <br />Gomersall, and Helon, Yes. Mr. Remmel abstained. <br />C. Remmel moved to nominate Ronald Bugala for Vice-Chairman, seconded. <br />by J. Helon. No other nominations were made. Roll call on motion: Remmel, <br />Helon, Gomersall, and Grace, Yes. Mr. Bugala abstained. <br />1. GTen, Penrod, 7100' Barton Road ' <br />Request for ruling. Grace (a memlier of the Board.) also a neighbor. <br />Mr. RemmeT expTained that there was no provision• for a pavilion• in the <br />zoning codes so-tlie Board will have to rule under what elassification it <br />shouTd be-eonsidered. Mr. Grace stated that, after some discuss.ion, it <br />was decided to consider the pavilion as a similar use to a shed. Variances <br />are: requir•ed.for size and location. Mr. Penrod explained that there was <br />an existing b uilding at this location which collapsed. He was advised'by <br />the Building Department that he could not replace the cement block building <br />under the current codes, and was advised that the former Building Commis- <br />sion would call him back. The Building Commissioner did not call back, <br />nor did he return subsequent calls. He then built the 12 foot high; <br />open pavilion on the existing foundation. C. Remmel moved that respond- <br />irig.to' the request for a ruling, that the Board has taken it under <br />advisement,and it is their decision to classify the structure as a shed, <br />subject to all the standards of a shed as reflected in our zoning regu- <br />lations, seconded by R. Bugala, and unanimously approved.. Mr. Remmel <br />stated that the variance would be limited to the structure as it stands <br />now. C. Remmel moved to grant a 284 square foot variance for a shed, <br />a height variance of 4 feet, and a location variance 75 feet from th.e <br />rear lot line, 42 feet from the southern lot line, and 23 feet from the <br />northern lot line and 105 feet from the garage, with the stipulation
