CITY OF NORTH OLMSTED <br />PLANNING COMMISSION <br />MINUTES-NOVEMBER 8, 1988 <br />I. P.OLL CALL : <br />Vice Chairman Thomas called the meeting to order at 8:05 p.m. <br />Present: R. Bierman, B. Gorris, J. Thomas, and E. Traczyk <br />Absent: M. Betts, R. Bowen, and T. Morgan <br />Also Present: Assistant Law Director J. Dubelko, Building Comriissioner <br />D. Conway, Consulting City Engineer S. Cesen, and Clerk of <br />Commissions B. Oring. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />The minutes of October 25th were amended to show that Consulting Engineer <br />T. Boyer as present. E. Traczyk moved to approve the minutes of October 25, 1988 <br />as amended, seconded by R. Bierman, and unanimously approved. <br />Vice-Chairman advised all present that there were only four members present <br />and four positive votes are required for a motion to pass. If any applicant <br />would like to withdraw, they may do so. <br />III. BUILDING DEPARTMENT REQUESTS: <br />1) Nightfall Night Club, 30850 Lorain Road <br />Review of site plan (continued from Planning Commission meeting of <br />January 27, 1987 as ordered by the court). <br />Heard by Architectural Board of Review September 21, 1988. <br />Tabled by Planning Commission October 25, 1988. <br />In reference to the court case, Assistant Law Director Dubelko advised <br />that Mr. Horvath had originally been prohibited from using the gravel <br />portion of the parking lot until it was paved, this decision was appealed, <br />has been heard, and should be resolved in the near future. The city did <br />file a motion that the business was not complying to the court order(saw <br />horses and tape used as a barracade were not effective), patrons still <br />parked in that area. After the court hearing this week, a snow fence has <br />been erected which the city considered a sufficient barracade. Mr_. Braun, <br />attorney, and Mr. Horvath, owner, presented plans explaining that the <br />Architectural Board of Review had approved the landscape plan and they <br />would like to obtain a permit to har.d surface the lot while weather <br />conditions permit. Tt was pointed out that the court order had permitted <br />them to do this without city approval, but Mr. Braun explained that the <br />contractor was reluctant to do that. Building Commission Conway advised <br />the plan shows 222 seats, requiring 112 parking spaces, and 121 spaces <br />are planned. P1r. Thomas would like the forester to check on a black <br />walnut tree to make suggestions regarding protecting that tree both <br />during construction and when the lot is paved. He also pointed out <br />that landscape plan notes that the existing arborvitae are to be removed, <br />and advised that they are in the city right of way and are maintained by <br />the homeowners association. Mr. Horvath and Mr. Braun explained proposal: <br />curb along the inside of the Hickory Lane sidewalk would be one to two <br />feet high; no handicapped ramn is shown since there were no steps to the <br />premisesY on addition pole light (identical to the existing) will be in- <br />stalled in the newly paved area (this is not shown on plan) and agreed
