Traczyk moved to approve the minutes of October 25, 1988
as amended, seconded by R. Bierman, and unanimously approved.
Vice-Chairman advised all present that there were only four members present
and four positive votes are required for a motion to pass. If any applicant
would like to withdraw, they may do so.
III. BUILDING DEPARTMENT REQUESTS:
1) Nightfall Night Club, 30850 Lorain Road
Review of site plan (continued from Planning Commission meeting of
January 27, 1987 as ordered by the court).
Heard by Architectural Board of Review September 21, 1988.
Tabled by Planning Commission October 25, 1988.
In reference to the court case, Assistant Law Director Dubelko advised
that Mr. Horvath had originally been prohibited from using the gravel
portion of the parking lot until it was paved, this decision was appealed,
has been heard, and should be resolved in the near future. The city did
file a motion that the business was not complying to the court order(saw
horses and tape used as a barracade were not effective), patrons still
parked in that area. After the court hearing this week, a snow fence has
been erected which the city considered a sufficient barracade. Mr_. Braun,
attorney, and Mr. Horvath, owner, presented plans explaining that the
Architectural Board of Review had approved the landscape plan and they
would like to obtain a permit to har.d surface the lot while weather
conditions permit. Tt was pointed out that the court order had permitted
them to do this without city approval, but Mr. Braun explained that the
contractor was reluctant to do that. Building Commission Conway advised
the plan shows 222 seats, requiring 112 parking spaces, and 121 spaces
are planned. P1r. Thomas would like the forester to check on a black
walnut tree to make suggestions regarding protecting that tree both
during construction and when the lot is paved. He also pointed out
that landscape plan notes that the existing arborvitae are to be removed,
and advised that they are in the city right of way and are maintained by
the homeowners association. Mr. Horvath and Mr. Braun explained proposal:
curb along the inside of the Hickory Lane sidewalk would be one to two
feet high; no handicapped ramn is shown since there were no steps to the
premisesY on addition pole light (identical to the existing) will be in-
stalled in the newly paved area (this is not shown on plan) and agreed
