? .? ? <br />I. ROLL CALL: <br />CITY OF NORTH OI,MS.TED <br />PLANNING COMMISSION <br />MINUTES-JULY 11, 1989 <br />Chairman Thomas called the meeting to order at 8:05 p.m. <br />Present: R. Bierman, R. Bowen, B. Gorris, T. Morgan, E. Traczyk, and J. Thomas. <br />Mr. Betts arrived at 8:12 p.m. <br />Also Present: Law Director Gareau, Building Commissioner Conway, Consulting <br />City Engineer Cesen, and Clerk of Commissions Oring. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />R. Bierman moved to approve the minutes of June 27, 1989, seconded by T. Morgan <br />and unanimously approved. <br />III. BUILDING DEPARTMENT REQUESTS: <br />Chairman Thomas advised that a new policy has been instituted and the Com- <br />mission will no longer begin any new discussion after 10:30 p.m. on a proposal <br />unless the Commission determines that an issue can be completed by 11:00 P.m. <br />1) Home Centers, Inc., located to the rear of Bob Evans Restaurant, <br />25853 Lorain Road " <br />Proposal to construct building. <br />Tabled at the meeting of June 27, 1989. <br />Chairman Thomas advised that this proposal had been tabled in order for a <br />committee of the Commission to meet with the Law Department and the develo- <br />pers regarding placing restriction on the proposal. Mr. Valore, attorney, <br />Mr. Cody, architect, and Mr. Hathaway, represented Home CenterG. i•ir.. <br />Valore advised that Mr. Betts had met with the Law Director and discussed <br />the possibility of issuing a temporary occupancy for Home Centers on the <br />basis that it would give the city more control over what would go onto the site in the future. Mr. Betts arrived at this point and confirmed tha.t <br />during the discussion with the Law Director it was determined that a tem- <br />porary occupancy could control the use of the rear parcel so that any <br />change in occupancy would revoke that occupancy. Mr: Betts clarified <br />that if another appliance:store, sucl-i as Fretters, took over Home Centers, <br />no change of occupancy would be required by the Commission, it wouid be <br />requzred if the use of the building changed. Mr. Valore advised that <br />they had made one final effort to ask Bob Evans to remove some of their <br />front parking spaces, and Bob Evans was not interested in talking about <br />it. Mr. Thomas advised that he had received a letter from Mr. Sohn of <br />the Architectural Board of Review statirig that he had reviewed the photo- <br />graphs of the building and had-no objection to it. J. Thomas moved to <br />approve the Home Center's plan, located at the rear-of Bob Evans Restaurant, <br />25853 Lorain Road, as provided by Home Centers and as has been reviewed <br />over the last several weeks and incorporating the suggestions of the <br />Architectura? Board of Review, Safety, and Engineering, seconded by T. <br />Morgan. Roll call on motion: Thomas, Morgan, Betts, Bierman, Bowen, <br />Gorris, and Traczyk, no. Motion failed to pass. Mr. Gorris explained <br />that this is a very unusual parcel and that the Commission has concerns
