ROLL CALL: <br />Chairman Thomas called the meeting to order at 8:05 p.m. <br />Present: M. Betts, R. Bierman, R. Bowen, B. Gorris, T. Morgan, E. Traczyk, <br />and J. Thomas. <br />Also present: Assistant Law Director J. Dubelko, Building Commissioner D. Conway, <br />Consulting City Engineer S. Cesen, and Clerk of Commissions B. Oring. <br />I?. REVIEW AND CORRECTION OF MINUTES: <br />The review of the minutes of May 23, 1989 will be deferred until the next meeting. <br />IIIo BUILDING DEPARTMENT REQUESTS: <br />Chairman Thomas advised that the agenda will be rearranged and item number 2 <br />will be heard first. <br />2) Nemeth Commercial Building, 29310 to 29352 Lorain Road <br />Proposal to constructadditional parking area. (Assembly Plat heard by <br />Planning Commission May 23, 1989). <br />Chairman Thomas explained that in response to the complaints mentioned dur- <br />ing the discussion of the assembly plat in reference to the Star Lounge in <br />the center, he had written a letter to the Safety Director advising him <br />of the neighbors`complaints. Safety Director Becker responded that he had <br />met with Mr. Lizanich, one of the complaining neighbors, to discuss his <br />problems. Mr. Becker further advised that he had reviewed the Police <br />Department reports concerning the property and that there had been 40 <br />police incidences in 1988, three of which were noise disturbances; in <br />1989 through May 26th there were 23 incidences, seven of which were noise <br />disturbances, and six of those seven were over a period of April to May. <br />Mr. Becker, who was present, further advised that there has been 3 more <br />complaints since that was written. In an effort to resolve this matter, <br />Mr. Becker has initiated several steps: The Fire Department is to determine <br />the maximum number of persons to be in the building at a given time and <br />that capacity was posted on June lst; all instances reported to the Police <br />will be forwarded to the city prosecutor for his review in light of a <br />liquor permit renewal for 1990; and the operators of the business have <br />been advised that this will be done. Mr. Becker further mentioned that <br />buffering the property might be helpful. Mr. Thomas read a letter from <br />Mr. Lizanich (see attached). Mr. Nemeth presented his proposal for in- <br />creased parking and advised that the additional parking is not just for <br />the Star Lounge. He advised that he has been living on the house on the <br />property and he too has been disturbed. Mr. Morgan pointed out that this <br />proposal practically doubles the parking that was originally approved with <br />the building plans. Mr. Kearis, part owner of the business, advised that <br />the Fire Department allowed them 139 seating capacity, and there were 93 <br />seats in the bar. Mr. Becker clarified that 139 occupancy was based on <br />occupancy within the structure, not on parking. Building Commissioner <br />Conway stated that this would also include standing, i1r. Morgan further <br />stated tHat this business could always take over the other units in the <br />building, so that any buffering proposed should include the whole building.
