W" <br />. <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES-APRIL 5, 1989 <br />Chairman Bugala called the meeting to order at 7:30 p.m. <br />Present: R. Gomersall, J. Helon, T. Restifo, and R. Bugala <br />Absent: B. Grace <br />Also present: Law Director M. Gareau, Chief Building Inspector D. Sanker, <br />and Clerk of Commissions B. Oring. <br />J. Helon moved to accept the minutes of March 1, 1989, seconded by T. Restifo, <br />and unanimously approved. <br />Chairman Bugala advised those present that item number l, Home Centers, has <br />been withdrawn by the developer and will be heard next month. <br />North Olmsted Lumber, 27375 Lorain Rd. <br />Request for variance (1123.12). Request variance to have gravel driveway. <br />Violation of Ord. 87-93, Section 1161.10-a. (Continued from meeting of <br />March 1, 1989). <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. Nesselhauf, representing North Olmsted Lumber, R. Noble, <br />Service Director for the City of North Olmsted, and Councilmen R. Bohlmann <br />and R. [+lilamosky. Mr. Noble explained that the city has reviewed this plan <br />and there is an area of their land which the city has been using for storage <br />and for a turn around for the salt trucks. With the approval of this proposal <br />the city would be given a perpetual easement. Pir. Noble pointed out that this <br />area is not to be used as a parking lot, it is for overflow storage of lumber; <br />and also since the proposal includes the installation of a solid fence to <br />match the city's fence both areas would be secured from vandalism. Mr. Nesselhauf <br />explained that they would have to use forklifts in that area, there would be <br />no room for tractor trailers. Councilman Bohlmann pointed out that even if <br />tractor trailers could not get back there, customers do drive back with private <br />vehicles, He believes that since the city is in litigation with another <br />business on Lorain Road for not paving their parking area, that granting this <br />variance would not be consiste.nt. Mr. Noble advised that there would be no <br />reason for customers to drive back there, this area is for overflow storage <br />which the city has requested:thento remove from the front of the property. <br />Councilman Wilamosky does not believe that a variance should be granted just <br />because the city will benefit, but this.request should be dec'ided on how it <br />will impact the city as a whole. He is concerned that the Service Director <br />is arguing for this and hopes that the city will not go. back to gravel <br />parking. Law Director Gareau advised that each case should be judged on its <br />own merits. Mr. Nesselhauf suggested that they could install a chain link <br />fence so that only his employees could get back there, and pointed out that <br />there would be nothing to stop them from storing the lumber on the ground <br />without putting in the gravel. T. Restifo moved to grant the variance for a <br />gravel driveway at North Olmsted Lumber at 27375 Lorain Road, seconded by <br />R. Gomersall. Roll call on motion: Restifo, Gomersall, Helon, and Bugala, <br />no. Motion failed to pass. Variance denied.
