CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - AUGUST l, 1990 <br />Chairman Bugala called the meeting to order at 7:30 p.ma <br />Present: R. Gomersall, J. Helon, T. Rest.ifo, and R. Bugala <br />Absent: B. Grace. <br />Also Present: Clerk of Commissions Oring and Chief Building Inspector Sanker <br />who arrived later after another meeting. <br />T. Restifo moved to approve the July 11, 1990 minutes as presented, seconded by <br />J. Helon, and unanimously approved. <br />1. Great Northern Mall (Biskind Development Company). <br />Request for variance (1123.12). Request variance to install 75 degree angle <br />parking with 9 foot wide by 18 foot deep stalls for parking lot renovation. <br />Withdrawn from meeting of July 11, 1990). <br />Chairman Bugala advised that the Great Northern request had been withdrawn by <br />the developer. <br />2. Robert F. Sossa, 2952 Clague Road. <br />Request for variance (1123.12). Request 13 foot front setback variance to <br />construct an addition. Violation of Ordo 87-93, Section 1135.06(a). Also <br />request special permit to add to non-conforming dwelling. Special permission <br />required Ord. 87-93, Section 1165.02. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Sossa. Mr. Bugala pointed out that the houses in <br />that area are all non-conforming. The members had no further questions. R. <br />Gomersall moved to grant the request of Robert F. Sossa at 2952 Clague Road for <br />a 13 foot front setback variance to construct an addition and also the special <br />permit to add to a non-conforming dwelling, seconded by T. Restifo, and <br />unanimously approved. Variance granted. <br />3. B. Wirtz & C. Boris-Wirtz, 4226 Bentley Drive. <br />Request for variance (1123e12). Request 9 foot rear yard variance to construct <br />two story addition. Violation of Ord. 87-93, Section 1135.008(a). <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. Wirtz, Ms Boris-Wirtz, and Mrs. M. Pope, the neighbor to the <br />rear. The proposal was explained to Mrs. Pope who stated that she was concerned <br />that the addition was to be located on the higher portion of the house. She was <br />advised that the addition would be 41 feet from her property line and that it <br />was to be on the lower side of the house. She was relieved that it was on the ? <br />lower side, but still objected on the basis it would devalue her property whi.ch <br />she intends to sell soon. Mrs. Pope maintains that the ma.ilman told her that <br />several people on.the list no longer at the addresses listed. The members had <br />no objection to the proposal. J. Helon moved to grant the request of B. Wirtz <br />and C. Boris-Wirtz at 4226 Bentley Drive for a 9foot rear yard variance to <br />construct an addition, seconded by R. Gomersall, and unanimously approvedo <br />Variance granted. <br />1
