. <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES-NOVIIKBER 8, 1990 <br />Chairman Bugala-called the meeting to order at 7:30 p.m. <br />Present: B. Grace, J. Helon, and R. Bugala <br />Absent: R. Gomersall and T. Restifo <br />Also Present: Law Director Gareau, Building Commissioner Conway, and Clerk of <br />Corrnnissions Oring. <br />Chair,nan Bugala advised those present that it takes 3 affirmative votes to <br />approve any request and there are only 3 of the 5 members present for this <br />meeting. If any applicant wishes to defer imtil the next meeting, he should <br />do so at this time, since he will not be able to withdraw after the case is <br />under discussion. <br />1. William L. Fri ic 29940 Lorain Road. <br />Request for variance (1123.12). Request 850 sq,. ft. variance to construct <br />detached garage. Vioiation of Ord. 87-93, Section 1135.02-c1. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. Frigic who explained the garage would have two 12 by 12 <br />foot doors, a 16 by 8 door, and a pedestrian door which is to be used for <br />recreational vehicles and cars. It would be 14 feet high. Nfr. BugaTa pointed <br />out that this property is being used as residential even though it is in the <br />General Retail district. A1r. Grace stated that this is a large lot and abuts <br />Metro Park propertg, and would be about about 230 feet back €rom the street. <br />Mr. Bugala is concerned because he has a truck which woulci not be aTlowed in a <br />residential district. Law Director Gareau stated that this is still commercial <br />property and a truck could be parked there. Building Commissioner Conway <br />agreed stating that this is commercial property, but it is regulated by the <br />abutting residentially zoned property since it is used residentially. He <br />clarified that if this were to be used as a commercial structure it would have <br />to go to Planning Conunissionm Mr. Gareau stated that the zoning regulates <br />uses, trucks cannot be parked in a residentially zoned district. 14r. Grace <br />stated that all this property is going to be retail and tfie lot is big enough <br />that it will not interfere wi.th any residentiaT use of adjoining properties. <br />B. Grace moved to grant to Mr. W. L. Frigic, 29940 Lorain Road, the request <br />for a 850 square foot variance to construct a detached garage, seconded by J. <br />Helon. Roll call on motion: Grace and Helon, yes. Mr. Bugala, no. Motion <br />failed to passe Variance denied. <br />2. Carter Plaza 24747 to 24781 Lorain Road. <br />Request for variance (1123.12). Request 54.6 square foot variance for total <br />sign area for several tenants in order to install their signage on proposed <br />conforming pole sign. (Based on removal of existing pole and ground signs). <br />Violation of Ord. 87-93, Section 1163.06-d. <br />Chairman Bugala called all interested parties before the Board. The oath was <br />administered to Mr. Leech, sign contractor, and r1s. Barkhurst, a tenant in the <br />Plaza. Mr. Leech explained that at the last meeting they were denied a <br />1
