<br />CITY OF NORTH OLMSTID <br />PLANNING COMNIISSION <br />MINUTES-NOVEMBER 12, 1991 <br />I. ROLL CALL: <br />Chairman Gorris called the meeting to order at 8:10 p.m. <br />Present: T. Morgan, L. Orlowski, A. Skoulis, and B. Gorris <br />Absent: R. Bowen, and J. Thomas. <br />Also Present: Assistant Law Director Dubelko, City Engineer Deichmann, Building <br />Commissioner Conway, and Clerk of Commissions Oring. <br />IIe REVIEW AND CORRECTION OF MINUTES: <br />Review of the minutes of October 8, 1991 will again be deferred. <br />In the minutes of October 22, 1991 Mr. Orlowski had advised that under <br />Comrmunications (page 6) it was stated Mr. Orlowski will be attending , this <br />should be changed to Mrm Orlowski ho es to attend. Also the reference of a hall <br />road on both page 2(last line) and on page 3 line 28) hall should be changed to <br />haul road. At this point there was a lengthy discussion by the members regarding <br />the minutes pertaininU to View Poi.nt since there was concern by certain <br />Commission members that Mr. Bower's indication as stated in the general <br />discussion of View Point as it relates to the City's opportunity to have first <br />right of refusal to purchase the golf course, was not included in the motion, and <br />upon review of the verbatim minutes, the members saw that it was not part of the <br />motion but there is some concern that the deed restriction should indicate that <br />the City have the right of first refusal on those parcels, and Mr. Skoulis will <br />make these concerns lmown at the B.Z.D. Committee. Assistant Law Director Dubelko <br />stated that he did not have an opinion, at this point, as to whether or not it <br />would be appropriate to have that type of first right of refusal language in a <br />restrictive covenant deed and if he kept it out of a covenant deed and put it in <br />a contract, then he would be concerned whether or not there would be any <br />consideration supporting the owner giving the City the right of first refusal <br />when a11 the City is giving in return are the rights that he is entitled to tmder <br />the Zoning Code. A. Skoulis moved to approve the minutes of October 22, 1991 as <br />corrected (hall to haul and hopes to attend), seconded by B. Gorris, and <br />unanimously approved. <br />III. BUILDING DEPARTLKIINT REQUESTS: <br />Interstate Development Company, 26261 Lorain Road (Lorain and Brookpark Roads) <br />Revision to site plan and landscaping including easement to share the existing <br />Cardinal Federal Savings and Loan drive. <br />Mr. Wasacz, the developer, explained that the existing curb cut for the building <br />is to be removed to eliminate a difficult left hand turn , and this property will <br />have an access by an easement that they have from Cardinal to create a shared <br />drive into the property with an internal drive to their parking area. Mr. Gorris <br />pointed out that this drive is across from a traffic light and Mr.. Morgan stated <br />that this might make it possible to use that building. The developers are <br />negotiating with a potential tenant for the building, but no agreement has been <br />finalized. Mr. Wasacz had met with Mr. Wendell, the forester, who reported as <br />follows:" On the east propertp line two Elms and one Spruce need to come out for <br />the drive to be connected with the Cardinal parking lot. All dead trees will be <br />removed along with undergrowth. The remaining trees will have their canopies
