<br />CITY OF NORTH OLMSTID <br />BOARD OF ZOIVING APPEALS <br />MINUTES - MAY 1, 1991 <br />Vice Chairman Restifo called the meeting to order at 7:35 p.m. <br />Present: E. Gallagher, B. Grace, J. Maloney, and T. Restifo <br />Absent: R. Gomersall <br />Also Present: Law Director Gareau, Building Commissioner Conway, and Clerk of <br />Commissions Oring. <br />B. Grace moved to approve the minutes of May 3, 1991, seconded by E. Gallagher, and <br />unanimously approved. <br />1. Brian Lancaster, 23214 Summerland Avenue <br />Request for variance (1123.12). Request 12 foot variance for distance between <br />proposed addition and detached garage. Also request 4.5 foot variance to garage <br />on adjacent property. Violation of Ord. 87 -93, Secti.on 1135.02-(c)1. <br />Vice Chairman Restifo called all interested parties before the Board. The oath was <br />administered to Mr. Lancaster who explained that he is adding to his home and there <br />would be about 8 feet between the addition and the existing garage. J. Gallagher <br />moved to grant the 12 foot vaxiance for the distance from proposed addition and <br />detached garage and also to grant the 4.5 foot variance for distance to garage on <br />adjacent property, seconded by B. Grace, . and tmanimously approved. Variances <br />granted. <br />2. Mr. and Mrs. G. Zander, 4210 Porter Roado <br />Request for variance (1123.12). Request 6 foot variance for distance between <br />addition and detached garage (building permit issued)a Violation of Ord. 87-93, <br />Section 1135.02-(c)1. <br />Vice Chairman Restifo called all interested paxties before the Board. The oath was <br />administered to Mr. and Mrs. Zander, and M. Kristof, contractor, who explained that <br />there would be 14 feet from the garage to the addition. Mr. Grace questioned if <br />there should be provisions for a fire wall. Building Commissioner Conway agreed that <br />any garage wall within 20 feet of the house should be fire walled. B. Grace moved <br />to grant the request for a 6 foot variance for the distance between the addition and <br />detached garage (building permit issued) under the condition that fire coding be put <br />on as stipulated by the Board, for Mr. and Mrs. G. Zander, 4210 Porter Road, <br />seconded by J. Maloney, and tmanimously approved. Variance granted. <br />3. J. B. & E. E. Schwab, 5515 McKenzie Road. <br />Request for variance (1123.12). Request 65 foot front set back variance <br />(over maximum) to construct carport. Violation of Ord. 87-93, Section <br />1135.06(a). Also, request special permit to add to non conforming dwelling. <br />Special permission required Ord. 87-93, Section 1165.02. <br />Vice Chairman Restifo called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Schwab, who clarified that the carport would be added <br />to the side of the house. J. Maloney moved to approve the request for a 65 foot <br />variance (over maximtun) to construct carport, and also grant special permit to add <br />to non- conforming dwelling for J. B. & E. E. Schwab, 5515 McKenzie Road, seconded <br />by E. Gallagher, and unanimously approved. Variance and special permit granted. <br />1
