<br />CITY OF NORTH OLMSTID <br />BOARD OF ZONING APPEALS <br />MINUTES - JULY 10, 1991 <br />Chairman Gomersall called the meeting to order at 7:35 p.m. <br />Present: B. Grace, J. Maloney, T. Restifo, and R. Gomersall. <br />Absent: E. Gallagher. <br />Also Present: Law Director Gareau, Building Commissioner Conway, and Clerk of <br />Commissions Oring. <br />J. Maloney moved to approve the June 5th minutes, seconded by T. Restifo, and <br />unani.mously approved. <br />1. Raymond and Julie Klesta, 5907 Barton Road. <br />Request for variance (1123.12). Request 3 foot front setback variance to <br />construct 2 story addition (variance required for second story). Violation of <br />Ord. 87-939 Section 1135.06-(a). Also request special permit to add to non- <br />conform;ng dwelling (front set back). Special permission required Ord. 87-93, <br />Section 1165.02. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Klesta, and neighbors, Mr. and Mrs. Patton, Mrs. <br />Kennedy, and Mr. and Mrs. Kopple, all of whom were in favor of the request. B. <br />Grace moved to grant the request for a 3 foot front setback variance to <br />construct a 2 story addition (variance required for second story); and also a <br />special permit to add to a non-confor?r!ing dwelling (front set back), seconded <br />by J. Maloney, and tmanimously approved. Variance and special permit granted. <br />2. Lamar Bonness, 3394 Tree Lane. <br />Request for variance (1123.12). Request 39 foot rear yard variance to <br />construct patio enclosure. Violation of Ord. 87-93, Section 1135.08(a). <br />Also request special permit to add to non-conforming dwelling. Spec3al permit <br />required Ord. 87-93, Section 1165.02. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Bonness who clarified that the enclosure would be <br />18 feet by 10 feet and would be 11 feet from the neighbors property line. Mr. <br />Maloney pointed out that the enclosure is next to the garage, and would need a <br />fire wall. Building Commissioner Conway agreed. T. Restifo moved to grant <br />Lamar Bonness at 3394 Tree Lane, the request for a 39 foot rear yard variance <br />to construct a patio enclosure and a special permit to add to a non-conforming <br />dwelling with the condition there must be a fire separation wall between the <br />enclosure and the garage, seconded by B. Grace, and tmanimously approved. <br />Variance and special permit granted. <br />3. First National Bank of Ohio, 26065 Lorain Road. <br />Request for variance (1123.12). Request 12.6 square foot variance to add <br />insert to pole sign. Violation of Ord. 87-93, Section 1163.06(f)-4. <br />1
