i <br /> <br />CITY F NORTH D <br />BOARD OF BUILDING CODE APPEALS <br />MINUTES -MARCH 26, 1992 <br />I. ROLL CALL: <br />Chairman Burk called the meeti.ng to order at 7:40 p.m. <br />Present: J. Kazak, W. Piar, and R. Burk <br />Absent: B. Schulz and D. Spoerke. <br />Also present: Building Commissioner Conway and C1erk of Commissions Oring. <br />II. REVIElJ AND CORRECTION OF MINUTES: <br />J. Kazak moved to accept the minutes of February 27, 1992 as written, <br />seconded by W. Piar, and unanimously approved. <br />III. COMMUIVICATIONS: <br />The Communications that were received are relative to one of the hearings and <br />will be when that request is discussed. <br />IV. HEARINGS : <br />Cha.irman Burk advised that hearing number 2 would be heard first. <br />2) Nicholas Motsis, 25142 Doe Drive. , <br />Request 4 inch variance for ceiling height 7 foot 6 inch height required, <br />7 foot 2 inch height requested to match the ceiling height of the adjacent <br />family room). Violation of Section R205. <br />The oath was administered to Mr. Motsis who explained that they are <br />constructing an addition for his mother-in-law who is in a wheel chair and the <br />floors must be level for access. If they lower the addition there would have <br />to be a step. Building Commissioner Conway stated that the ceiling height was <br />still at 7 foot 2 inches which is perniitted for corridors and other areas. <br />This would not hinder any egress from the structure. J. Ka,zak mved to accept <br />the request of Nicholas Motsis, 25142 Doe Drive to change the ceiling height <br />to 7 foot, 2 inches, seconded by W. Pier, and imanimously approved. <br />1) James A. Miller, property located between 5938 and 5918 Porter Road. <br />Request permission to construct dwelling on permanent parcel rnnnber 235-14-59, <br />sublot 300, ("B" District, min;m,m, lot frontage 70 feet). Hearing required by <br />Ord. 2806 (any house being built on a lot with a 50 foot front width or less <br />requires the approval of the Board of Building Code Appeals.) <br />Approval given by Board of Building Code Appeals on February 27, 1992 with <br />condition that the Engineering Department review the impact of this proposal <br />on the entire area. <br />Variance will be required from the Board of Zoning Appeals for the above <br />proposal. <br />Chairman Burk explained that since the February meeting several things have <br />happened. He read a memo dated March 3, 1992 to Tom Wolf, Public Works <br />Commissioner from Dave McDermott, Engineering Department, regarding South <br />Porter Road Drainage (see attached). 14emo dated March 11, 1992 to Pau1 <br />Deichmann, City Engineer, from Dave McDermott (see attached). Memo dated March <br />13, 1992 to Richard Burk, Chairman of the Board of Building Code Appeals from <br />Paul Deichmann (see attached). *The oath was administered to Councilwoman <br />Bahas, Mrs. Gravenstreter, Mr. Eichelberger, Mrs. Hosier, Ms. Knight, Mr. <br />Miller, Mr. Schmidt, 14r. and Mrs. Mitchell. Mr. Miller advised the neighbors
