<br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES-AUGUST 5, 1992 <br />Chairman Gomersall called the meeting to order at 7:30 p.m. <br />?. <br />`Present: B. Grace, J. Maloney, and R. Gomersall <br />Absent: T. Koberna and W. Purper <br />Also Present: Law Director Gareau, Chief Building Inspector Sanker, and <br />Clerk of Commissions Oring. <br />J. Maloney moved to approve the m-inutes of the July 2, 1992 meeting, seconded by <br />B. Grace, and unanimously approved. <br />Chairman Gomersall advised that since there are only 3 members present and it <br />takes 3 affirmative votes for approval, all requests will require approval from <br />all three members; anyone who wishes to delay his request until next month must <br />do so now. Request variance to have second wall sign; <br />request 91.7 square foot vaxiance for sign area for a business unit; request <br />variance 106.7 square foot variance for sign area for frontage of building and <br />request 1 foot variance for encroachment of wall sign into minirrmm of 3.0 foot <br />setback from parting wall and also from end-of building. Violations of Ord. 90- <br />125, Sections 1163.12(a); 1163.11(c) and (a); and 1163.04(a). <br />Coritinued from meeting of July 2, 1992. <br />No representative present, request was continued until the end of the meeting. <br />Auto Accents, 25021 Lorain Road. <br />Request for variance (1123:12). Request variance to use existing prohibited <br />pole sign and request variance a devi.se (.back lit awning) visible from a public <br />way and designated to direct attention to a building. Please Note: signs <br />inStalled without first obtaining a permit. Violations of Ord. 90-125, Section <br />1163.22(a) and-163.03. <br />Continued froan meeting of July 2, 1992. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. Yousef, owner. Mr. Gomersall reviewed the history of this <br />request: last February of 1992 a letter was sent advising him to remove all <br />non-permitted signage, later in February he was told 'that permits were needed <br />for his signs; when permits were reguested; it was determined that a variance <br />was needed; after tha.t a window sign was.i.nstalled; other letters were sent and <br />finally in April an application for a varianee was-completed by the owner. Mr. <br />Yousef stated that these letters'were.sent to the store rather thari to his <br />office as he had requested. He also had stated°on the variance application that <br />Mr. Bis, sign inspector, had-been "an his back". He is now requesting to use a <br />prohibited pole.sign and to keeg the back lit`awning. Mr. Yousef maintained that <br />the awning had been lighted.mainly for security,. and had only been on for a <br />total of'two hours when he was cited. He stated that he did want to do business <br />in this city and wanted to be a good.neighbor, pointing out that he put $20,000. <br />into renovating a run down, dilapidated;building.and all he received,from the <br />City was a citation. He-believed that he, was being harassed since other' <br />liuildings have been in bad condition for yeaxs. He maintained tha.t he bought a <br />building which had signs built into it, so he would not have to deal with the <br />1
