? <br />,?,.. <br />CITY OF NORTH OLMSTED <br />BOARD OF ZODTING APPEALS <br />MINUTES- AUGIJST 4, 1993 <br />Chairman Gomersall called the meeting to order at 7:30 p.m. <br />Present: T. Koberna, W. Purper, and R. Gomersall. <br />Absent: B. Grace and J. Ma.loney. <br />Also Present: Law Director Gareau, Building Commissioner Conway, and Clerk of <br />Comnissions Oring.. <br />Chairman Gomersall explained to the audience that anly 3 members would be <br />present at this meeting and'it would require 3 affirmative votes to approve a <br />request. He asked if any applicant wished to withdraw tmtil the next meeting, <br />when prestnnably there will be a full board, he may do so at this time. He further <br />advised that each ca.se will be judged on the physical situation peculiar to <br />itself and no judgement should be considered to be a general policy judgement <br />effecting properties or like situations elsewhere. The representative of Clark <br />Oil (item ninnber 3) asked to withdraw from the agenda until the next meeting, but <br />was concerned: si.nce two signs had already been installed on the canopy and <br />questioned what would.happen. Building Coimnissioner Gonway advised that no action <br />would be taken imtil a decision was made at the next meeting. <br />David and Verna Kokitka, 7139 Barton Road. <br />Request for variance (1123.12). Request 425 square foot variance for area of <br />accessory building exceedirrg 2% of rear yard area; also requires a 6 foot height <br />variance; and a 5 foot rear setback variance. Accessory building to be used for <br />storage and a game room. Violations of Ord. 90-125, Sections 1135.02(d)-(1), (3), <br />and (4). Continued fran meeting of July 7, 1993. <br />Chairman had been ad.vised that the applicant had withdrawn this proposal <br />indefinitely. <br />1. Tire America, 25801 Lorain Road. <br />Request for variance (1123.12). Request variance to ha.ve second wall sign (one <br />allowed); request 44 square foot varianee for total sign area allowed for the <br />building; request 59 squa.re foot varianee allowed for a business use; request <br />variance to have grourxi sigp in restricted 35 foot triangular area; and request <br />variance to have a second free standing sign an ane property. Violations of Ord. <br />90-125, Sections 1163.12(a); 1163.11(b); 1163.11(a); and 1163.12(b). <br />Chairman Gomersall ca.lled all interested parties before the Board. The oath was <br />administered to Mr. Howell, representing Tire America. Building Conuni.ssioner <br />Conway advised that there had been an error in calculating the square footage of <br />these signs. The variance for tlie two.wall signs will now be 16 square feet and <br />the variance for the overall signage should be 31 square feet instead of 59 <br />square feet. Mr. Howell advised that variance was needed because they are taking <br />over the Hyperstore building which is behind Bob Evans Restaurant and faces <br />Brookpark Road, but has no entrance on Brookpark. Consequently they need two wall <br />signs, one facing Brookpark and ane an the Lorain Road side. A ground sign will <br />also be needed at the Bob Evens entrance drive to indicate this is the drive for <br />Tire America. During the approval process they ha.d agreed to replace the existing <br />Hyperstore pole sigp with a.conforming ground sign, however there is no place to <br />put that sign which will con£orm to the ordinance. The members had no problem <br />with the request. Mr. Conway had sent a letter to the mer.ibers stating his concern <br />with the location off the side yard even though it conforms, he believed there <br />1
