<br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES-JULY 7, 1993 <br />Chairman Gomersall called the meeting to order at 7:40 p.m. <br />Present: B. Grace, T. Koberna, J. Maloney, and R. Gomersall. <br />Absent: W. Purper. <br />Also Present: Law Director M. Gareau, Chief Building Inspector D. Sanker, and <br />Clerk of Commissions Oring. <br />Chairman Gomersall advised all present that the board members had viewed the <br />premises involved in each case and that 3 affirmative votes are required for <br />approval. Each case would be judged on the physical situation peculiar to itself <br />so that in no way is a judgement rendered considered to be a general policy <br />judgement affecting properties or like situations elsewhere. <br />1. Kevin and Anna Durst, 6501 Surrey Drive. <br />Request for variance (1123.12). Request variance to construct 6 foot solid fence <br />in side yard of corner lot to be located in front of the required building <br />setback of the abut*ing lot on the si:de street. Violation of Ord. 90-125, Section <br />1135.02(f)(2). <br />Chairman Gomersall called all interested parties before the board. The oath was <br />administered to Mr. Uurst and Mr. Athey, neighbor. Mr. Gomersall presented a <br />letter objecting to the request. Mr. Durst explained that he is requesting a 6 <br />foot fence for the safety of his family and to protect them from frequent <br />trespassers. Mr. Athey and some other neighbors feel that a 6 foot fence is too <br />high. The neighbors are concerned about a fence 1 foot off the sidewalk and were <br />worried that teenagers would be tempted to write graffiti on a solid fence. Since <br />there are only houses on one side of the street, this would also be a good place <br />for people to park. Mr. Musiel the neighbor to the rear located on Christman <br />Drive, directly behind the Durst's has a 5 foot high wooden fence. Mr. Durst said <br />that he would accept what ever type of fence the board would a11ow. Mr. Gomersall <br />thinks that there would be too much fence. If a subsequent resident moved in the <br />fence might not be maintained. The members feel that one house having a 5 foot <br />fence and another one having a 6 foot fence would not look right. Chief Building <br />Inspector advised that he could not put the fence on the line, it joould have to, <br />be behind the setback. Mr. Grace suggested that installing a 5 foot board on <br />board fence with gaps in between each board making it fifty percent open. This <br />would lessen the possibility of graffiti because they will have to jump from <br />board to board. The members also want at least 5 feet of green area in between <br />the street and fence for the safety of people walking along the fence. B. Grace <br />moved to grant the request for Kevin and Anna Durst, 6501 Surrey Drive request <br />variance to construct a 6.foot solid fence which is changed to a 5 foot solid <br />fence on side yard of a corner lot. The fence will be a board on board fence with <br />a 4%2 5 inch gap between boards and a 5 foot setback from the sidewalk on Sutton <br />Drive, seconded by J. Maloney, and unanimously approved. Variance granted. <br />2. Thomas E. Heim, 24128 Mapleridge Road. <br />Request for variance (1123.12). Request 3 foot side yard variance to construct <br />addition to detached garage. Violation of Ord. 1135.02(c)(2). <br />1
