?- •. , .. <br />CITY OF NORTH OLMSTED <br />PLANNING COMNffSSION <br />MINUTES-APRIL 26, 1994 <br />I. ROLL CALL: <br />Chairman Gorris called the meeting to order at 7:40 p.m. <br />Present: D. Alston, P. Miller, L. Orlowski, R. Tallon, J. Thomas, and B. Gorris. <br />Absent: K. 0'Rouz'ke <br />Also Present: City Engineer Deichmann, Assistant City Engineer Griffith, <br />Building Comnissioner Comaay and Clerk of Commissions Oring. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />The minutes were deferred until the end of the meeting. <br />III. BITILDING DEPARTMIINT REQUESTS: <br />1) Wendy's Restaurant, 26650 Lorain Road <br />Proposal to construct small addition to restaurant and reconfigure parking area. <br />Referred to Board of Zoning Appeals March 29; 1994. Heard by Board of Zoning <br />Appeals April 6, 1994. Heard by Architectural Board of Review April 20, 1994. <br />No representative was present. Delayed until the end of the meeting and tabled <br />at that time to the next ineetinge <br />IV. NEW DEVIIAPMQNTS AND SUBDNISIONS : <br />1) Dennis and Georgene Carlton Subdivision, <br />The proposal is to subdivide permanent parcels no. 234-18-21 location is on the <br />south side of Vita Lane (east off Barton Road) and owned by the city of North <br />Olmsted, into three (3) buildable lots. Zoning is B- Residence, Single, entirely <br />and the proposal conforms to the Zoning Code requirements for frontage and area. <br />Tabled at the meeting of April 12, 1994. <br />City Engineer Deichmann advised that it was his understanding that the Law <br />Director's questions had been answered. Mr. Andreano, engineer, presented plans. <br />No neighbors were present and the members had no questions. B. Thomas moved to <br />approve the subdivision of permazzent parcel numbers 234-18-21 on the south side <br />of Vita Lane into three (3) buildable lots, seconded by P. Miller. During the <br />framing of the motion, Mra Deichmarm clarified that the city did own the lots but <br />there had been an agreement between the city and the pa.rties originally involved <br />in this transaction that if the city did not use the property it would be deeded <br />back to the original developers. This transaction is a result of that original <br />agreement. A representative of developers, Gity Line Estates, explained the <br />agreement, that if the city did not use the property as a park, it would revert <br />to them. Fifteen years ago, it was decided not to use it, but it was not sold at <br />that time. The motion was approved tmanimously. <br />Chairman Gorris called a short recess since the Wal-Mart developers had been <br />advised their proposal would not be heard until 8:00 p.m. <br />2) Wal-Mart Stores, Inc., Property located on Brookpark Road, east of the Westbury <br />Apartments and west of Colebrook and Clareshire Condominiums. <br />Heard by Board of Zoning Appeals on March 9, 1994. <br />Heard by Architectural Review Board an April 20, 1994. <br />Heard by Architectural Review Board on April 26, 1994 at 5:30 pam. <br />1
