) <br />..../ <br />CITY OF NORTH OLMSTED <br />BOARD OF BUII.DING CODE APPEALS <br />MINUT'ES - SEPTEMBER 22, 1994 <br />Prior to the meeting, Vice Chairman Kazak and Building Commissioner Conway explained to the <br />applicants that since there were only 3 members present, and in order to have a request approved, <br />3 affirmative votes would be needed. The applicants would have the right to withdraw if they <br />prefer to. <br />1. ROLL CALL: <br />Vice Chairmau Kazak called the meeting to order at 7:35 p.m. <br />Mr. Lusardo considered withdrawing, but after some discussion, decided not to. <br />Present: P. Engoglia, W. Piar, and J. Ka.zak. <br />Absent: R. Burk and D. Spoerke <br />Also Present: Building Commissioner Conway and Clerk of Commissions Oring. <br />II. REVIEW AND CORRECTIONS OF MINUTES: <br />P. Engoglia moved to accept the minutes of August 1, 1994 as submitted; seconded by J. Kazak, <br />and unauimously approved. Mr. Kazak had 2 conections to the minutes of Ju1y 21, 1994, <br />(minutes had been approved previously) but he does not have them with him. He will fax them to <br />the clerk. Corrections received from Mr. Kazak for Ju1y 21st minutes: page 1, seconded last line, <br />after P. Engoglia moved, insert the word avproved; on page 2, under Old Business 8th line from <br />the bottom after the word discussing, add the subiect of licensing private home in5pectors. <br />III. COMMUNiCATIONS: <br />No items. <br />IV. HEARINGS: <br />1) RA.G. Custom Homes, sublot 22, 30051 Wellington Drive <br />Request variance to have guards on loft more than 4 inches apart. Also hand grips exceed 2-5/8 <br />inch maximum. Violation of Section R214.2 of the 1989 CABO One and Two Family Dwelling <br />Code. <br />Mr. Gary Case, the owner of the home, decided not to withdraw. Mr. Case presented pictures and <br />explained that the black railing was 1.5 inches by 3 inches, and the opening space between the top <br />and the first bar is 4.25 inches, the middle is 5 inches, and the middle and third bar is 5.5 inches. <br />W. Engoglia was more concerned about the opening between the floor and the third bar. Mr. Piar <br />stated that a baby might fall through this opening. Mr. Case offered to put acrylic glass on the <br />opening from the bottom to the floor. He believed that there was not much more than a 7 inch <br />opening which is about the same in the railing in City Ha1L Mr. Engoglia believed that it was more <br />like 10 inches, but he was only able see it from the outside. It was agreed that if this opening was <br />under 6 inches, it would be all right as is, but if it were over 6 inches, he should either install the <br />acrylic glass or put in another rail. J. Kazak moved to approve the hand railing and the horizontal <br />bars on the railin.g for RA.G. Gustom Homes, sublot 22, 30051 Wellington Drive with the
